1 1 Section 1. PARTICIPATION IN AN INSTRUCTIONAL SUPPORT
1 2 PROGRAM BY SCHOOL DISTRICTS == SUSPENSION OF REQUIREMENTS.
1 3 Notwithstanding any contrary provision in chapter 257,
1 4 including sections 257.18 through 257.21, a school district
1 5 that has participated in a board=approved instructional
1 6 support program during the fiscal year beginning July 1, 2005,
1 7 and ending June 30, 2006, may continue to participate in the
1 8 board=approved instructional support program for the fiscal
1 9 year beginning July 1, 2006, and ending June 30, 2007, to the
1 10 extent established by the board's resolution, as if it had
1 11 complied with those sections, if all of the following apply:
1 12 1. The board of directors of the school district has
1 13 adopted or adopts a resolution not later than May 15, 2006, to
1 14 participate in the board=approved instructional support
1 15 program as otherwise provided in section 257.18. If the board
1 16 of directors has adopted a budget which did not account for
1 17 the board=approved instructional support program, the board of
1 18 directors may adjust its budget to account for the
1 19 board=approved instructional support program as approved by
1 20 the department of management.
1 21 2. The secretary of the board of directors does not
1 22 receive a petition as authorized in section 257.18, subsection
1 23 2, within twenty=eight days following the adoption of the
1 24 resolution by the board of directors of the school district to
1 25 participate in the board=approved instructional support
1 26 program as provided in subsection 1, which asks that an
1 27 election be called to approve or disapprove the action of the
1 28 board of directors in adopting the resolution.
1 29 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 30 immediate importance, takes effect upon enactment.
1 31 EXPLANATION
1 32 This bill provides a school district which has participated
1 33 in an instructional support program approved by its board of
1 34 directors during the fiscal year beginning July 1, 2005, and
1 35 ending June 30, 2006, may continue to participate in the
2 1 board=approved instructional support program for the fiscal
2 2 year beginning July 1, 2006, and ending June 30, 2007,
2 3 notwithstanding that its board of directors failed to adopt a
2 4 resolution to participate in the board=approved instructional
2 5 support program as otherwise required in Code section 257.18.
2 6 Under the bill, the board of directors must comply with two
2 7 requirements. First, the board must have adopted or must
2 8 adopt the resolution not later than May 15, 2006. The board
2 9 may adjust its budget to account for the board=approved
2 10 instructional support program as approved by the department of
2 11 management. Secondly, the board's secretary cannot have
2 12 received a petition as authorized in Code section 257.18
2 13 asking that an election be called to approve or disapprove the
2 14 action of the board in adopting the resolution, within 28 days
2 15 following the adoption of the board's resolution.
2 16 The bill takes effect upon enactment.
