                                      A BILL FOR

  1 An Act to legalize actions taken and proceedings conducted by the
  2    Walnut Community School District which relates to erroneously
  3    certified instructional support levy and providing an
  4    effective date.
  5    WHEREAS, due to an error in determining the ending date of the
  6 Instructional Support Levy, the Board of Directors of the Walnut
  7 Community School District certified its budget for Fiscal Year
  8 2006=2007 including the Instructional Support Levy when in fact
  9 the prior levy expires on June 30, 2006; and
 10    WHEREAS, the Board of Directors of the Walnut Community School
 11 District has adopted a resolution to hold a hearing to
 12 participate in the Instructional Support Program by Board action
 13 for one year commencing July 1, 2006; NOW THEREFORE,
 14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  For the fiscal year beginning July 1, 2006, and
  1  2 ending June 30, 2007, notwithstanding anything contrary in
  1  3 section 257.18, if the board of directors of the Walnut
  1  4 Community School District adopts a resolution, not later than
  1  5 May 10, 2006, to participate in the instructional support
  1  6 program under section 257.18 and a petition is not filed
  1  7 within twenty=eight (28) days following the adoption of the
  1  8 resolution by the board, the school district shall be
  1  9 permitted to participate in the instructional support program
  1 10 for the fiscal year ending June 30, 2007 to the extent set by
  1 11 the board resolution.
  1 12    Section 2.  This Act being deemed of immediate importance
  1 13 takes effect on enactment.
  1 14                           EXPLANATION
  1 15    This bill legalizes the action of the board of directors of
  1 16 the Walnut community school district to participate in an
  1 17 instructional support levy program for the fiscal year
  1 18 beginning July 1, 2007, and ending June 30, 2008, which was
  1 19 due to an error in determining the ending date of the
  1 20 instructional support levy.
