                                      A BILL FOR

  1 An Act to legalize participation in an instructional support
  2    program by the Waterloo community school district, and
  3    providing an effective date.
  4    WHEREAS, an instructional support program for the Waterloo
  5 community school district ends on June 30, 2006; and
  6    WHEREAS, the board of directors of the Waterloo community
  7 school district did adopt a resolution to participate in the
  8 instructional support program on April 10, 2006; and
  9    WHEREAS, the Waterloo community school district erred in not
 10 allowing twenty=eight days for the filing of a petition between
 11 the adoption of the instructional support program resolution and
 12 the adoption of the certified budget; and
 13    WHEREAS, the boards of directors of the Waterloo community
 14 school district did include a provision for the instructional
 15 support program in its certified budget adopted on April 10,
 16 2006; NOW THEREFORE,
 17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Notwithstanding any contrary provision in
  1  2 chapter 257, including sections 257.18 through 257.21, if a
  1  3 petition is not filed within twenty=eight days following the
  1  4 adoption of the resolution by the board to participate in the
  1  5 instructional support program, the school district may
  1  6 participate in the instructional support program funded as
  1  7 provided by state law for the fiscal year beginning July 1,
  1  8 2006, and ending June 30, 2007, to the extent established by
  1  9 the board's resolution.
  1 10    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 11 immediate importance, takes effect on enactment.
  1 12                           EXPLANATION
  1 13    This bill legalizes the action of the Waterloo community
  1 14 school district to participate in an instructional support
  1 15 program which includes financing for the fiscal year beginning
  1 16 July 1, 2006, and ending June 30, 2007, notwithstanding that
  1 17 the board of directors did not allow 28 days for the filing of
  1 18 a petition between the adoption of the instructional support
  1 19 program resolution and the adoption of the certified budget.
  1 20    The bill takes effect upon enactment.
