1 1 Section 1. NEW SECTION. 135.151 CHROMATED COPPER
1 2 ARSENATE TREATED WOOD.
1 3 The department shall collect and disseminate information
1 4 regarding the possible negative health effects of exposure to
1 5 wood and wood=like products treated with chromated copper
1 6 arsenate and formulate recommendations regarding precautions
1 7 which should be taken to prevent exposure to arsenic and other
1 8 pesticidal compounds in the treated wood. The department
1 9 shall publish the information in a format that can be easily
1 10 duplicated and distributed by wholesalers and retailers of
1 11 chromated copper arsenate treated wood and wood=like products
1 12 pursuant to section 206.26 and shall also provide the
1 13 information on the department's official website.
1 14 Sec. 2. NEW SECTION. 206.26 CHROMATED COPPER ARSENATE
1 15 TREATED WOOD.
1 16 A wholesaler or retailer of chromated copper arsenate
1 17 treated wood or wood=like products in this state shall
1 18 conspicuously post a notice that the wholesaler or retailer
1 19 sells chromated copper arsenate treated wood or wood=like
1 20 products at or near the point of display or customer selection
1 21 of such treated wood or wood=like products. The notice shall
1 22 be in at least twenty=two point type and shall include a
1 23 telephone number for the Iowa department of public health at
1 24 which a customer can obtain additional information regarding
1 25 possible negative health effects of exposure to chromated
1 26 copper arsenate treated wood or wood=like products. A
1 27 wholesaler or retailer of chromated copper arsenate treated
1 28 wood or wood=like products shall also provide information
1 29 produced by the Iowa department of public health pursuant to
1 30 section 135.151 in a conspicuous location readily available to
1 31 customers.
1 32 EXPLANATION
1 33 This bill relates to the dissemination of information
1 34 concerning chromated copper arsenate treated wood. The bill
1 35 provides that the Iowa department of public health shall
2 1 collect and disseminate information regarding possible
2 2 negative health effects of exposure to wood treated with
2 3 chromated copper arsenate, a chemical mixture of arsenic,
2 4 chromium, and copper. The bill requires the department to
2 5 publish the information for distribution by wholesalers and
2 6 retailers of chromated copper arsenate treated wood and to
2 7 place the information on the department's website.
2 8 The bill provides that a wholesale or retail seller of
2 9 chromated copper arsenate treated wood shall post a notice
2 10 that the wholesaler or retailer sells chromated copper
2 11 arsenate treated wood at a location near the display of the
2 12 wood. The notice must include a telephone number for
2 13 customers to contact the Iowa department of public health for
2 14 more information about the health effects of chromated copper
2 15 arsenate treated wood and be printed in at least a 22 point
2 16 type. A wholesale or retail seller must also provide
2 17 information prepared by the department about chromated copper
2 18 arsenate treated wood. Failure to post the notice is a
2 19 serious misdemeanor. A serious misdemeanor is punishable by
2 20 confinement for no more than one year and a fine of at least
2 21 $250 but not more than $1,000.
