  1 An Act requiring the department of human services to provide a
  2    form for documenting the use of an exception to a limitation
  3    on the number of reserve bed days authorized for a state
  4    supplementary assistance recipient residing in a residential
  5    care facility.

  1  1    Section 1.  RESERVE BED DAYS DUE TO VISITS OR VACATION.
  1  2 The department of human services shall develop a form in a
  1  3 one=page or other simple=to=use format that may be used by a
  1  4 family member, legal guardian, or other person authorized
  1  5 under 441 IAC 52.1(3)(e), to provide signed documentation to a
  1  6 residential care facility that an individual recipient of
  1  7 state supplementary assistance who is a resident of the
  1  8 facility desires visit or vacation days in addition to the
  1  9 thirty days otherwise allowed and that the days are for the
  1 10 resident's benefit.  The department shall provide copies of
  1 11 the form to residential care facilities and the facilities
  1 12 shall provide the forms, as needed, to residents' family
  1 13 members, legal guardians, and other persons authorized to
  1 14 provide the signed documentation.
  1 15                           EXPLANATION
  1 16    This bill requires the department of human services to
  1 17 develop a form for documenting the use of an exception to the
  1 18 limitation on the number of reserve bed days authorized for a
  1 19 state supplementary assistance recipient residing in a
  1 20 residential care facility (RCF).  Under administrative rule
  1 21 441 IAC 52.1(3)(e), payment to an RCF is provided for up to 30
  1 22 calendar days per year when a resident is absent overnight for
  1 23 purposes of a visit or vacation.  An exception is allowed so
  1 24 that the 30 days may be exceeded if signed documentation is
  1 25 provided by the resident's family member, legal guardian,
  1 26 physician, case manager, or department service worker that the
  1 27 additional days are desired by the resident and are for the
  1 28 benefit of the resident.  In order to be paid, the RCF must
  1 29 have the documentation in the resident's file for each period
  1 30 of absence in excess of the 30 days.
  1 31    The bill requires the department to provide copies of the
  1 32 form to residential care facilities and the facilities must
  1 33 provide the forms, as needed, to residents' family members,
  1 34 legal guardians, and other persons authorized to provide the
  1 35 signed documentation.
