  1  1    Section 1.  Section 249A.30, Code 2005, is amended to read
  1  2 as follows:
  1  3    249A.30  HOME AND COMMUNITY=BASED SERVICES WAIVER ==
  1  4 SERVICE PROVIDER REIMBURSEMENT.
  1  5    1.  The base reimbursement rate for a provider of services
  1  6 provided under a medical assistance program home and
  1  7 community=based services waiver for persons with mental
  1  8 retardation shall be recalculated at least every three years
  1  9 to adjust for the changes in costs during the immediately
  1 10 preceding three=year period annually, at the beginning of the
  1 11 fiscal year.
  1 12    2.  The annual inflation factor used to adjust such a
  1 13 provider's reimbursement rate for a fiscal year shall not
  1 14 exceed the percentage increase in the employment cost index
  1 15 for private industry compensation issued by the federal
  1 16 department of labor, bureau of labor statistics, for the most
  1 17 recently completed calendar year be determined based on the
  1 18 total skilled nursing facility market basket index utilized by
  1 19 the centers for Medicare and Medicaid services of the United
  1 20 States department of health and human services.
  1 21                           EXPLANATION
  1 22    This bill provides that the reimbursement for providers of
  1 23 services under any medical assistance program home and
  1 24 community=based services waiver is to be recalculated,
  1 25 annually, at the beginning of the fiscal year.  The annual
  1 26 inflation factor to be used, instead of the current percentage
  1 27 increase in the employment cost index for private industry
  1 28 compensation issued by the federal department of labor, bureau
  1 29 of labor statistics, for the most recently completed calendar
  1 30 year, is the skilled nursing facility market basket index
  1 31 utilized by the centers for Medicare and Medicaid services of
  1 32 the United States department of health and human services.
