SALE OF RHODES RESEARCH FARM. 1 2 1. Iowa state university of science and technology shall 1 3 develop a plan to sell the two=thousand=eight=acre tract of 1 4 land located near the town of Rhodes in Marshall county 1 5 commonly referred to as the Iowa state university Rhodes 1 6 research farm to the Iowa department of natural resources for 1 7 purposes of the clear creek lake project. Prior to 1 8 implementing the plan, the university shall submit the plan to 1 9 the state board of regents for review and approval. 1 10 Appraisals conducted by the university of the value of any 1 11 portion of the tract shall be made available to the public 1 12 immediately following the sale of that portion of the tract. 1 13 2. The proceeds from the sale of the property as provided 1 14 in subsection 1 are appropriated to and shall be retained by 1 15 Iowa state university of science and technology for use by the 1 16 Iowa state university college of agriculture. 1 17 3. The provisions of section 262.9, subsection 7, and 1 18 section 262.10 shall not apply to the sale of any portion of 1 19 land to be sold in accordance with this section or to the use 1 20 of the proceeds from the sale of the land, except that no 1 21 member of the board or any of its committees, offices, or 1 22 agencies, nor any officer of any institution, shall be 1 23 directly or indirectly interested in such purchase or sale. 1 24 4. By December 15 annually, the state board of regents 1 25 shall submit a report of the activities and costs of the sale 1 26 of any property in accordance with subsection 1, including but 1 27 not limited to the use of any proceeds from the sale of the 1 28 property and the environmental cleanup costs for any proposed 1 29 sale in accordance with this section, to the general assembly 1 30 in accordance with section 7A.11A, and to the legislative 1 31 services agency, until such time as the sale of the property 1 32 is complete and the proceeds have been expended by the 1 33 university, at which time the state board of regents shall 1 34 submit a final report on the sale of the property and use of 1 35 the proceeds to the general assembly in accordance with 2 1 section 7A.11A and to the legislative services agency. 2 2 EXPLANATION 2 3 This bill requires Iowa state university (ISU) of science 2 4 and technology to develop a plan to sell the 2,008=acre Rhodes 2 5 research farm, located near the town of Rhodes in Marshall 2 6 county, to the department of natural resources for purposes of 2 7 the clear creek lake project. The bill appropriates any 2 8 proceeds from the sale of the property to ISU for use by the 2 9 university's college of agriculture. 2 10 Prior to implementing the plan, the university shall submit 2 11 the plan to the state board of regents for review and 2 12 approval. Appraisals conducted by the university of the value 2 13 of any portion of the tract shall be made available to the 2 14 public immediately following the sale of that portion of the 2 15 tract. 2 16 The bill requires ISU to submit its plan to the board for 2 17 review and approval prior to implementing the plan and 2 18 prohibits anyone on the board and any officer of the 2 19 institution from having an interest in the sale. However, the 2 20 bill exempts the sale of the Rhodes research farm and the use 2 21 of the proceeds from the sale from current Code provisions 2 22 that require the board to acquire real estate for the proper 2 23 uses of institutions under its control, and to dispose of real 2 24 estate belonging to the institutions when not necessary for 2 25 their purposes, and which prohibits the sale of real estate 2 26 except upon the order of the board, at a regular meeting, or 2 27 one called for that purpose, and in such manner and under such 2 28 terms as the board may prescribe. 2 29 By December 15 annually, until the property is sold and the 2 30 proceeds expended, the board must submit a report of the 2 31 activities and costs of the sale of the Rhodes property, 2 32 including but not limited to the use of any proceeds from the 2 33 sale of the property and the environmental cleanup costs for 2 34 any proposed sale, to the general assembly and the legislative 2 35 services agency.
