  1  1    Section 1.  Section 600B.25, Code Supplement 2005, is
  1  2 amended to read as follows:
  1  3    600B.25  FORM OF JUDGMENT == CONTENTS OF SUPPORT ORDER ==
  1  4 EVIDENCE == COSTS == POSTSECONDARY EDUCATION SUBSIDY.
  1  5    1.  Upon a finding of paternity pursuant to section
  1  6 600B.24, the court shall establish the father's monthly
  1  7 support payment and the amount of the support debt accrued or
  1  8 accruing pursuant to section 598.21B.  The support obligation
  1  9 shall include support of the child between the ages of
  1 10 eighteen and nineteen years if the child is engaged full=time
  1 11 in completing high school graduation or equivalency
  1 12 requirements in a manner which is reasonably expected to
  1 13 result in completion of the requirements prior to the person
  1 14 reaching nineteen years of age.  The court may order the
  1 15 father to pay amounts the court deems appropriate for the past
  1 16 support and maintenance of the child and for the reasonable
  1 17 and necessary expenses incurred by or for the mother in
  1 18 connection with prenatal care, the birth of the child, and
  1 19 postnatal care of the child and the mother, and other medical
  1 20 support as defined in section 252E.1.  The court may award the
  1 21 prevailing party the reasonable costs of suit, including but
  1 22 not limited to reasonable attorney fees.
  1 23    2.  A copy of a bill for the costs of prenatal care or the
  1 24 birth of the child shall be admitted as evidence, without
  1 25 requiring third=party foundation testimony, and shall
  1 26 constitute prima facie evidence of amounts incurred.
  1 27    3.  Upon a finding of paternity pursuant to section
  1 28 600B.24, the court may also order a postsecondary education
  1 29 subsidy as defined in section 598.1 and as provided in section
  1 30 598.21F.  The construction, application, and interpretation of
  1 31 this subsection shall be the same as the construction,
  1 32 application, and interpretation of sections 598.l and 598.21F.
  1 33                           EXPLANATION
  1 34    This bill authorizes the court, upon a finding of
  1 35 paternity, to order a postsecondary education subsidy in
  2  1 addition to support of the child.  The postsecondary education
  2  2 subsidy is to be ordered in accordance with the provisions
  2  3 established for a postsecondary education subsidy ordered
  2  4 under a dissolution of marriage.
  2  5    The bill also provides that the construction, application,
  2  6 and interpretation of the bill relating to the postsecondary
  2  7 education subsidy under Code chapter 600B (paternity and
  2  8 obligation for support) is to be the same as the construction,
  2  9 application, and interpretation of the definitional and
  2 10 provisional sections relating to the postsecondary education
  2 11 subsidy under Code chapter 598 (dissolution of marriage and
  2 12 domestic relations).
