  1  1    Section 1.  Section 123.50, subsection 3, paragraphs b and
  1  2 c, Code 2005, are amended to read as follows:
  1  3    b.  A second violation within two years shall subject the
  1  4 licensee or permittee to a thirty=day suspension and a civil
  1  5 penalty in the amount of one thousand five hundred dollars.
  1  6 Failure to pay the civil penalty before the expiration of the
  1  7 thirty=day suspension period shall result in continued
  1  8 suspension until the fine is paid.
  1  9    c.  A third violation within three years shall subject the
  1 10 licensee or permittee to a sixty=day suspension and a civil
  1 11 penalty in the amount of one thousand five hundred dollars.
  1 12 Failure to pay the civil penalty before the expiration of the
  1 13 sixty=day suspension period shall result in continued
  1 14 suspension until the fine is paid.
  1 15                           EXPLANATION
  1 16    This bill provides for continued suspension of a license or
  1 17 permit held by a retail liquor control licensee, wine
  1 18 permittee, or beer permittee for failure to pay a civil
  1 19 penalty imposed for a second or third violation of selling
  1 20 alcoholic beverages to a minor.  The bill provides that
  1 21 failure to pay the required penalty during the suspension
  1 22 period shall result in the continued suspension of the license
  1 23 until the penalty is paid.
