  1  1    Section 1.  Section 543B.15, subsection 10, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    10.  An applicant for an initial real estate broker's or
  1  4 salesperson's license shall be subject to a national criminal
  1  5 history check through the federal bureau of investigation.
  1  6 The commission shall request the criminal history check and
  1  7 shall provide the applicant's fingerprints to the department
  1  8 of public safety for submission through the state criminal
  1  9 history repository to the federal bureau of investigation.
  1 10 The applicant shall authorize release of the results of the
  1 11 criminal history check to the real estate commission.  The
  1 12 applicant shall pay the actual cost of the fingerprinting and
  1 13 criminal history check, if any.  Unless the criminal history
  1 14 check was completed within the ninety calendar days prior to
  1 15 the date the license application is received by the real
  1 16 estate commission, the commission shall reject and return the
  1 17 application to the applicant.  If the criminal history check
  1 18 is delayed due to the inadequacy of the fingerprints provided
  1 19 to the federal bureau of investigation, the commission shall
  1 20 issue the applicant a temporary license to remain in effect
  1 21 until the criminal history check has been completed.  The
  1 22 results of a criminal history check conducted pursuant to this
  1 23 subsection shall not be considered a public record under
  1 24 chapter 22.
  1 25                           EXPLANATION
  1 26    Applicants for licensure as a real estate broker or
  1 27 salesperson are required to submit fingerprint samples as part
  1 28 of a criminal background check.  This bill provides for a
  1 29 temporary license in the event the background check is delayed
  1 30 due to an error in taking the fingerprint sample.
