  1  1    Section 1.  Section 423.2, subsection 11, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    11.  a.  All Except as provided in paragraph "b", all
  1  4 revenues arising under the operation of the provisions of this
  1  5 section shall be deposited into the general fund of the state.
  1  6    b.  Revenues arising from the tax in this section imposed
  1  7 on the sale of horses shall be credited and are appropriated
  1  8 to the state equine development commission.
  1  9    Sec. 2.  CONTINGENT EFFECTIVENESS.  This Act is contingent
  1 10 upon and takes effect only upon the establishment of a state
  1 11 equine development commission pursuant to an Act enacted
  1 12 during the Eighty=first General Assembly, 2006 Session.
  1 13                           EXPLANATION
  1 14    This bill provides for the appropriation of sales tax
  1 15 revenues generated from the sale of horses to the state equine
  1 16 development commission.  The bill is contingently effective
  1 17 upon the establishment of such commission during the 2006
  1 18 legislative session.
