1 An Act increasing the scheduled fines for certain violations by
2 motor vehicle operators under age eighteen.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 321.1, Code Supplement 2005, is amended
1 2 by adding the following new subsection:
1 3 NEW SUBSECTION. 7A. "Cell phone" or "cellular telephone"
1 4 means any device used for remote two=way communication
1 5 including but not limited to a mobile telephone, two=way
1 6 radio, wireless electronic mail device, or two=way pager.
1 7 Sec. 2. Section 805.8A, Code Supplement 2005, is amended
1 8 by adding the following new subsection:
1 9 NEW SUBSECTION. 15. UNDERAGE LICENSEE == VIOLATION AND
1 10 ACCIDENT WHILE USING CELL PHONE. The scheduled fine for any
1 11 moving traffic violation committed by a motor vehicle operator
1 12 under chapter 321, as provided in this section, shall be
1 13 doubled if all of the following apply:
1 14 a. The motor vehicle operator was under eighteen years of
1 15 age at the time of the violation.
1 16 b. The violation occurred in connection with a motor
1 17 vehicle accident.
1 18 c. The motor vehicle operator was using a cell phone, as
1 19 defined in section 321.1, at the time the violation occurred.
1 20 EXPLANATION
1 21 This bill doubles the scheduled fine for any moving traffic
1 22 violation committed by a person under 18 years of age if the
1 23 violation occurred in connection with a motor vehicle accident
1 24 and the motor vehicle operator was using a cell phone or
1 25 similar device at the time the violation occurred.
