A BILL FOR
1 An Act requiring school districts and accredited nonpublic
2 schools to establish media centers supervised by qualified
3 media services specialists, and providing for a waiver and a
4 future effective date.

1 1 Section 1. Section 256.7, subsection 24, Code Supplement
1 2 2005, is amended to read as follows:
1 3 24. Adopt rules on or before January 1, 2001, to require
1 4 school districts and accredited nonpublic schools to adopt
1 5 local policies relating to health services, media services
1 6 programs, and guidance programs, as part of the general
1 7 accreditation standards applicable to school districts
1 8 pursuant to section 256.11. This subsection shall be
1 9 applicable strictly for reporting purposes and shall not be
1 10 interpreted to require school districts and accredited
1 11 nonpublic schools to provide or offer health services, media
1 12 services programs, or guidance programs.
1 13 Sec. 2. Section 256.11, Code Supplement 2005, is amended
1 14 by adding the following new subsection:
1 15 NEW SUBSECTION. 9. Unless a waiver has been obtained
1 16 under section 256.11A, each school or school district shall
1 17 establish a media center in each attendance center which shall
1 18 be accessible to students throughout the school day and shall
1 19 be supervised by a school media specialist licensed and
1 20 appropriately endorsed by the board of educational examiners
1 21 under chapter 272. In determining the requirements of this
1 22 subsection for accredited nonpublic schools, the department
1 23 shall evaluate the schools on a school system basis rather
1 24 than on an individual school basis.
1 25 Sec. 3. Section 256.11A, subsection 2, Code 2005, is
1 26 amended to read as follows:
1 27 2. Not later than August 1, 1995 2007, for the school year
1 28 beginning July 1, 1995 2007, the board of directors of a
1 29 school district, or authorities in charge of a nonpublic
1 30 school, may file a written request with the department of
1 31 education that the department waive the rule adopted by the
1 32 state board requirement to establish and operate a media
1 33 services program to support the total curriculum for that
1 34 district or school center supervised by a media services
1 35 specialist as provided in section 256.11, subsection 9. The
2 1 procedures specified in subsection 3 apply to the request.
2 2 Not later than August 1, 1996 2008, for the school year
2 3 beginning July 1, 1996 2008, the board of directors of a
2 4 school district or the authorities in charge of a nonpublic
2 5 school may request an additional one=year extension of the
2 6 waiver.
2 7 Sec. 4. FUTURE EFFECTIVE DATE. This bill takes effect
2 8 July 1, 2007.
2 9 EXPLANATION
2 10 This bill requires that each school district or accredited
2 11 nonpublic school establish, unless a waiver has been obtained,
2 12 a media center in each attendance center which shall be
2 13 supervised by an appropriately licensed and endorsed school
2 14 media specialist. In determining the requirements for
2 15 accredited nonpublic schools, however, the department is
2 16 directed to evaluate the schools on a school system basis
2 17 rather than on an individual school basis. School districts
2 18 and accredited nonpublic schools may apply for a waiver and a
2 19 one=year extension of the waiver for FY 2007=2008 and FY
2 20 2008=2009.
2 21 The bill takes effect July 1, 2007.
2 22 The bill may include a state mandate as defined in Code
2 23 section 25B.3.
