1 An Act concerning requirements applicable to social gambling
2 games between individuals and in places with a liquor or beer
3 permit or license.

1 1 Section 1. Section 99B.6, subsection 1, paragraph h, Code
1 2 2005, is amended to read as follows:
1 3 h. No participant wins or loses more than a total of fifty
1 4 dollars or more consideration equivalent thereto or wins more
1 5 than a total of two hundred dollars or more consideration
1 6 equivalent thereto in one or more games or activities
1 7 permitted by this section at any time during any period of
1 8 twenty=four consecutive hours or over that entire period. For
1 9 the purpose of this paragraph a person wins the total amount
1 10 at stake in any game, wager, or bet, regardless of any amount
1 11 that person may have contributed to the amount at stake.
1 12 Sec. 2. Section 99B.12, subsection 1, paragraph a, Code
1 13 2005, is amended by striking the paragraph.
1 14 Sec. 3. Section 99B.12, subsection 1, paragraph g, Code
1 15 2005, is amended to read as follows:
1 16 g. No participant wins or loses more than a total of fifty
1 17 dollars or other consideration equivalent thereto or wins more
1 18 than a total of two hundred dollars or more consideration
1 19 equivalent thereto in one or more games or activities
1 20 permitted by this section at any time during any period of
1 21 twenty=four consecutive hours or over that entire period. For
1 22 the purpose of this paragraph a person wins the total amount
1 23 at stake in any game, wager, or bet, regardless of any amount
1 24 that person may have contributed to the amount at stake.
1 25 Sec. 4. Section 99B.12, subsection 2, paragraph a, Code
1 26 2005, is amended to read as follows:
1 27 a. Card and parlor games, including and tournaments. Card
1 28 and parlor games include but are not limited to poker,
1 29 pinochle, pitch, gin rummy, bridge, euchre, hearts, cribbage,
1 30 dominoes, checkers, chess, backgammon, pool, and darts.
1 31 However, it shall be unlawful gambling for any person to
1 32 engage in bookmaking, or to play any punchboard, pushcard,
1 33 pull=tab, or slot machine, or to play craps, chuck=a=luck,
1 34 roulette, klondike, blackjack, chemin de fer, baccarat, faro,
1 35 equality, three=card monte, or any other game, except poker,
2 1 which is customarily played in gambling casinos and in which
2 2 the house customarily provides a banker, dealer, or croupier
2 3 to operate the game, or a specially designed table upon which
2 4 to play the game.
2 5 EXPLANATION
2 6 Code section 99B.6, concerning permissible social gambling
2 7 games where liquor or beer is sold, is amended in the bill to
2 8 allow a participant to win no more than $200 instead of the
2 9 current limit of $50 in a 24=hour period. Current law capping
2 10 losses at $50 is unchanged by the bill.
2 11 Code section 99B.12, concerning games between individuals,
2 12 is also amended. The bill eliminates the requirement that
2 13 gambling permitted under the Code section must be incidental
2 14 to a bona fide social relationship between all participants.
2 15 In addition, the bill allows a participant to win no more than
2 16 $200 instead of the current $50 limit in a 24=hour period.
2 17 Current law capping losses at $50 is unchanged by the bill.
2 18 The section is also amended to permit tournaments of allowable
2 19 card and parlor games.
