  1  1    Section 1.  Section 462A.15, subsection 1, Code 2005, is
  1  2 amended to read as follows:
  1  3    1.  a.  No A person shall not operate a vessel on any
  1  4 waters of this state under the jurisdiction of the commission
  1  5 for towing and tow a person or persons on water skis, a
  1  6 surfboard, or a similar device unless there is in such vessel
  1  7 a responsible person, in addition to the operator, is in the
  1  8 vessel in a position to observe observing the progress of the
  1  9 person or persons being towed.
  1 10    b.  If a person being towed by a vessel on water skis, a
  1 11 surfboard, or a similar device falls into the water, the
  1 12 operator shall ensure that the responsible person raises a red
  1 13 or orange flag to alert other vessels that a person is in the
  1 14 water, until the person is removed from the water or is again
  1 15 being towed.
  1 16                           EXPLANATION
  1 17    This bill provides that if a person being towed by a vessel
  1 18 on water skis, a surfboard, or a similar device falls into the
  1 19 water, the operator of the vessel must ensure that a
  1 20 responsible person, who is not the operator, raises a red or
  1 21 orange flag to alert other vessels that a person is in the
  1 22 water, until the person is removed from the water or is again
  1 23 being towed.
  1 24    A person who violates this provision is subject to a
  1 25 scheduled fine of $25.
