  1  1    Section 1.  Section 15E.192, subsection 3, paragraph b,
  1  2 Code Supplement 2005, is amended to read as follows:
  1  3    b.  A county or city may apply to the department for an
  1  4 area to be certified as an enterprise zone at any time prior
  1  5 to March 1, 2006.  A county or city may apply for
  1  6 recertification of an enterprise zone if the original
  1  7 certification of the enterprise zone is scheduled to expire by
  1  8 February 28, 2011.  However, the total amount of land
  1  9 designated as enterprise zones under subsections 1 and 2, and
  1 10 any other enterprise zones certified by the department,
  1 11 excluding those approved pursuant to section 15E.194,
  1 12 subsection 4, shall not exceed in the aggregate one percent of
  1 13 the total county area.
  1 14    Sec. 2.  Section 15E.192, subsection 4, Code Supplement
  1 15 2005, is amended to read as follows:
  1 16    4.  An enterprise zone designation shall remain in effect
  1 17 for ten years following the date of certification or
  1 18 recertification.  Any state or local incentives or assistance
  1 19 that may be conferred must be conferred before the designation
  1 20 expires.  However, the benefits of the incentive or assistance
  1 21 may continue beyond the expiration.
  1 22                           EXPLANATION
  1 23    This bill relates to enterprise zone certifications.
  1 24    The bill provides that a county or city may apply to the
  1 25 department of economic development for recertification of an
  1 26 enterprise zone if the original certification of the
  1 27 enterprise zone is scheduled to expire by February 28, 2011.
  1 28 The bill provides that an enterprise zone recertification
  1 29 shall remain in effect for 10 years, which is the same length
  1 30 of time that the original certification is in effect.
