1 1 Section 1. Section 135.39B, Code 2005, is amended to read
1 2 as follows:
1 3 135.39B EARLY CHILDHOOD IMMUNIZATIONS == MERCURY CONTENT.
1 4 1. a. Beginning January 1, 2006, early childhood
1 5 immunizations administered in this state shall not contain
1 6 more than trace amounts of mercury.
1 7 b. Beginning January 1, 2007, early childhood
1 8 immunizations for influenza administered in this state and
1 9 immunizations administered to pregnant or nursing women in
1 10 this state shall not contain more than trace amounts of
1 11 mercury.
1 12 2. For the purposes of this section:
1 13 a. "Early childhood immunizations" means immunizations
1 14 administered to children under eight years of age, unless
1 15 otherwise provided in this section.
1 16 b. "Trace amounts" means trace amounts as defined by the
1 17 United States food and drug administration.
1 18 3. The prohibition under this section shall not apply to
1 19 early childhood immunizations for influenza or in times of
1 20 emergency or epidemic as determined by the director of public
1 21 health. If an emergency or epidemic is determined to exist by
1 22 the director of public health under this subsection, the
1 23 director of public health shall notify the state board of
1 24 health, the governor, and the legislative council, and shall
1 25 notify the public upon request.
1 26 EXPLANATION
1 27 This bill amends provisions relating to the mercury content
1 28 of immunizations. The bill eliminates the exception to
1 29 limitations on mercury content for early childhood
1 30 immunizations for influenza, and requires that beginning
1 31 January 1, 2007, early childhood immunizations for influenza,
1 32 like all other early childhood immunizations administered in
1 33 the state, contain no more than trace amounts of mercury. The
1 34 bill also requires that, beginning January 1, 2007,
1 35 immunizations administered to pregnant or nursing women in
2 1 this state shall not contain more than trace amounts of
2 2 mercury.
