  1  1    Section 1.  Section 35A.5, subsection 9, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    9.  Establish and operate a state veterans cemetery and
  1  4 make application to the government of the United States or any
  1  5 subdivision, agency, or instrumentality thereof, for funds for
  1  6 the purpose of establishing such a cemetery.  There is
  1  7 appropriated annually from the general fund of the state to
  1  8 the department the sum of three hundred seventy=five thousand
  1  9 dollars for the purpose of establishing and operating a state
  1 10 veterans cemetery.  The state may enter into agreements with
  1 11 any subdivision of the state for assistance in operating the
  1 12 cemetery.  The state shall own the land on which the cemetery
  1 13 is located.  The department shall have the authority to accept
  1 14 federal grant funds, funding from state subdivisions,
  1 15 donations from private sources, and federal "plot allowance"
  1 16 payments.  All such funds shall be deposited into an account
  1 17 dedicated to the establishment, operation, and maintenance of
  1 18 a veterans cemetery and these funds shall be expended only for
  1 19 those purposes.  The department through the director shall
  1 20 have the authority to accept suitable cemetery land, in
  1 21 accordance with federal veterans cemetery grant guidelines,
  1 22 from the federal government, state government, state
  1 23 subdivisions, private sources, and any other source wishing to
  1 24 transfer land for use as a veterans cemetery.  Notwithstanding
  1 25 section 8.33, any moneys in the account for a state veterans
  1 26 cemetery shall not revert and, notwithstanding section 12C.7,
  1 27 subsection 2, interest or earnings on moneys deposited in the
  1 28 fund shall be credited to the account.
  1 29                           EXPLANATION
  1 30    This bill appropriates $375,000 annually to the department
  1 31 of veterans affairs to establish and operate a state veterans
  1 32 cemetery.
