1 An Act relating to Medicaid reform through the use of managed
2 care and opt=out provisions.

1 1 Section 1. MEDICAID REFORM WAIVER. The department of
1 2 human services shall request a waiver from the centers for
1 3 Medicare and Medicaid services of the United States department
1 4 of health and human services to provide for capitated managed
1 5 care under the Medicaid program which allows a Medicaid
1 6 recipient to customize the recipient's benefits package to
1 7 meet the unique needs of the recipient and to allow the
1 8 Medicaid recipient to opt out of the Medicaid program and use
1 9 a state=allocated premium to participate in the Medicaid
1 10 recipient's employer=sponsored health care plan. The waiver
1 11 shall include provisions which encourage Medicaid recipients
1 12 to engage in healthy lifestyles by allowing them to earn
1 13 credits to be used for approved health=related expenses and
1 14 which require participating health care plans to collect and
1 15 report information such as consumer satisfaction and waiting
1 16 times for customer assistance. The department of human
1 17 services shall report the progress regarding the waiver
1 18 request to the general assembly on a periodic basis.
1 19 EXPLANATION
1 20 This bill requires the department of human services to
1 21 request a waiver from the centers for Medicare and Medicaid
1 22 services of the United States department of health and human
1 23 services to provide for capitated managed care under the
1 24 Medicaid program which allows a Medicaid recipient to
1 25 customize the recipient's benefits package to meet the unique
1 26 needs of the recipient and to allow the Medicaid recipient to
1 27 opt out of the Medicaid program and use a state=allocated
1 28 premium to participate in the Medicaid recipient's employer=
1 29 sponsored health care plan. The waiver is to include
