1 An Act relating to county, city, and school board publication of
2 allowed claims.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 28M.4, subsection 8, Code Supplement
1 2 2005, is amended to read as follows:
1 3 8. Immediately following a regular or special meeting of a
1 4 commission, the secretary of the commission shall prepare a
1 5 condensed statement of the proceedings of the commission and
1 6 cause the statement to be published not more than twenty days
1 7 following the meeting in one or more newspapers which meet the
1 8 requirements of section 618.14. The statement shall include a
1 9 list of all claims allowed, showing the name of the person or
1 10 firm making the claim, the reason for the claim, and the
1 11 amount of the claim. Two or more claims made by the same
1 12 vendor or supplier may be consolidated if the number of claims
1 13 consolidated and the total consolidated claim amount are
1 14 listed in the statement. Salary claims must show the gross
1 15 amount of the claim except that salaries paid to persons
1 16 regularly employed by the commission, for services regularly
1 17 performed by the persons, shall be published once annually
1 18 showing the gross amount of the salary.
1 19 Sec. 2. Section 279.35, Code 2005, is amended to read as
1 20 follows:
1 21 279.35 PUBLICATION OF PROCEEDINGS.
1 22 The proceedings of each regular, adjourned, or special
1 23 meeting of the board, including the schedule of bills allowed,
1 24 shall be published after the adjournment of the meeting in the
1 25 manner provided in this section and section 279.36, and the
1 26 publication of the schedule of the bills allowed shall include
1 27 a list of claims allowed, including salary claims for services
1 28 performed. The schedule of bills allowed may be published on
1 29 a once monthly basis in lieu of publication with the
1 30 proceedings of each meeting of the board. The list of claims
1 31 allowed shall include the name of the person or firm making
1 32 the claim, the purpose of the claim, and the amount of the
1 33 claim. Two or more claims made by the same vendor or supplier
1 34 may be consolidated if the number of claims consolidated and
1 35 the total consolidated claim amount are listed in the
2 1 statement. However, salaries paid to individuals regularly
2 2 employed by the district shall only be published annually and
2 3 the publication shall include the total amount of the annual
2 4 salary of each employee. The secretary shall furnish a copy
2 5 of the proceedings to be published within two weeks following
2 6 the adjournment of the meeting.
2 7 Sec. 3. Section 331.471, subsection 6, paragraph d, Code
2 8 2005, is amended to read as follows:
2 9 d. Immediately following a regular or special meeting of a
2 10 commission, the secretary of the commission shall prepare a
2 11 condensed statement of the proceedings of the commission and
2 12 cause the statement to be published as provided in section
2 13 331.305. The statement shall include a list of all claims
2 14 allowed, showing the name of the person or firm making the
2 15 claim, the reason for the claim, and the amount of the claim.
2 16 Two or more claims made by the same vendor or supplier may be
2 17 consolidated if the number of claims consolidated and the
2 18 total consolidated claim amount are listed in the statement.
2 19 Salary claims must show the gross amount of the claim except
2 20 that salaries paid to persons regularly employed by the
2 21 commission, for services regularly performed by the persons
2 22 shall be published once annually showing the gross amount of
2 23 the salary. In counties having more than one hundred fifty
2 24 thousand population the commission shall each month prepare in
2 25 pamphlet form the statement required in this paragraph for the
2 26 preceding month, and furnish copies to the public library, the
2 27 daily and official newspapers of the county, the auditor, and
2 28 to persons who apply at the office of the secretary, and the
2 29 pamphlet shall constitute publication as required. Failure by
2 30 the secretary to make publication is a simple misdemeanor.
2 31 Sec. 4. Section 349.18, Code 2005, is amended to read as
2 32 follows:

2 34 PUBLICATION.
2 35 1. All proceedings of each regular, adjourned, or special
3 1 meeting of a board of supervisors, including the schedule of
3 2 bills allowed, shall be published immediately after the
3 3 adjournment of the meeting, and the.
3 4 2. The publication of the schedule of the bills allowed
3 5 shall include a list of all claims allowed, including salary
3 6 claims for services performed, showing the name of the person
3 7 or firm making the claim and the amount of the claim, except
3 8 that the publication of claims shall comply with the
3 9 following:
3 10 a. The names of persons receiving relief shall not be
3 11 published. and salaries
3 12 b. The salaries paid to persons regularly employed by the
3 13 county shall only be published annually showing the total
3 14 amount of the annual salary.
3 15 c. Two or more claims made by the same vendor or supplier
3 16 may be consolidated if the number of claims consolidated and
3 17 the total consolidated claim amount are listed in the
3 18 statement.
3 19 3. The county auditor shall furnish a copy of the
3 20 proceedings to be published, within one week following the
3 21 adjournment of the board.
3 22 Sec. 5. Section 372.13, subsection 6, Code 2005, is
3 23 amended to read as follows:
3 24 6. Within fifteen days following a regular or special
3 25 meeting of the council, the clerk shall cause the minutes of
3 26 the proceedings of the council, including the total
3 27 expenditure from each city fund, to be published in a
3 28 newspaper of general circulation in the city. The publication
3 29 shall include a list of all claims allowed and a summary of
3 30 all receipts and shall show the gross amount of the claim.
3 31 Two or more claims made by the same vendor or supplier may be
3 32 consolidated if the number of claims consolidated and the
3 33 total consolidated claim amount are listed in the statement.
3 34 Matters discussed in closed session pursuant to section 21.3
3 35 shall not be published until entered on the public minutes.
4 1 However, in cities having more than one hundred fifty thousand
4 2 population the council shall each month print in pamphlet form
4 3 a detailed itemized statement of all receipts and
4 4 disbursements of the city, and a summary of its proceedings
4 5 during the preceding month, and furnish copies to the city
4 6 library, the daily newspapers of the city, and to persons who
4 7 apply at the office of the city clerk, and the pamphlet shall
4 8 constitute publication as required. Failure by the clerk to
4 9 make publication is a simple misdemeanor. The provisions of
4 10 this subsection are applicable in cities in which a newspaper
4 11 is published, or in cities of two hundred population or over,
4 12 but in all other cities, posting the statement in three public
4 13 places in the city which have been permanently designated by
4 14 ordinance is sufficient compliance with this subsection.
4 15 Sec. 6. Section 388.4, subsection 4, Code 2005, is amended
4 16 to read as follows:
4 17 4. Immediately following a regular or special meeting of a
4 18 utility board, the secretary shall prepare a condensed
4 19 statement of the proceedings of the board and cause the
4 20 statement to be published in a newspaper of general
4 21 circulation in the city. The statement must include a list of
4 22 all claims allowed, showing the name of the person or firm
4 23 making the claim, the reason for the claim, and the amount of
4 24 the claim. Two or more claims made by the same vendor or
4 25 supplier may be consolidated if the number of claims
4 26 consolidated and the total consolidated claim amount are
4 27 listed in the statement. Salary claims must show the gross
4 28 amount of the claim except that salaries paid to persons
4 29 regularly employed by the utility, for services regularly
4 30 performed by them, must be published once annually showing the
4 31 gross amount of the salary. In cities having more than one
4 32 hundred fifty thousand population the utility board shall each
4 33 month prepare in pamphlet form the statement herein required
4 34 for the preceding month, and furnish copies to the city
4 35 library, the daily newspapers of the city, the city clerk, and
5 1 to persons who apply at the office of the secretary, and the
5 2 pamphlet shall constitute publication as required. Failure by
5 3 the secretary to make publication is a simple misdemeanor.
5 4 EXPLANATION
5 5 This bill changes how a city or county, including a
5 6 regional transit district commission, county enterprise
5 7 commission, or city utility board, publishes a list of allowed
5 8 claims. Similarly, the bill changes how a school board
5 9 publishes a list of allowed claims. Two or more claims made
5 10 by the same vendor or supplier may be consolidated if the
5 11 number of claims consolidated and the total consolidated claim
5 12 amount are listed in the statement.
