1 An Act relating to motor vehicle registration fees for motor
2 trucks weighing less than eight thousand pounds.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 321.1, Code Supplement 2005, is amended
1 2 by adding the following new subsection:
1 3 NEW SUBSECTION. 95. "Work truck" means a motor truck not
1 4 used for hire, with an unladen weight of less than eight
1 5 thousand pounds, owned by a person engaged in farming or a
1 6 business, and used primarily to transport products or
1 7 equipment essentially related to the vehicle owner's farming
1 8 or business operation or essentially related to the vehicle
1 9 owner's employment with a farming or business operation.
1 10 Sec. 2. Section 321.109, subsection 1, unnumbered
1 11 paragraph 1, Code Supplement 2005, is amended to read as
1 12 follows:
1 13 The annual fee for all motor vehicles including vehicles
1 14 designated by manufacturers as station wagons, and 1993 and
1 15 subsequent model years for multipurpose vehicles, and motor
1 16 trucks with an unladen weight of less than eight thousand
1 17 pounds, except motor trucks registered pursuant to section
1 18 321.120, 321.121, or 321.122, motor homes, ambulances,
1 19 hearses, motorcycles, motor bicycles, and 1992 and older model
1 20 years for multipurpose vehicles, shall be equal to one percent
1 21 of the value as fixed by the department plus forty cents for
1 22 each one hundred pounds or fraction thereof of weight of
1 23 vehicle, as fixed by the department. The weight of a motor
1 24 vehicle, fixed by the department for registration purposes,
1 25 shall include the weight of a battery, heater, bumpers, spare
1 26 tire, and wheel. Provided, however, that for any new vehicle
1 27 purchased in this state by a nonresident for removal to the
1 28 nonresident's state of residence the purchaser may make
1 29 application to the county treasurer in the county of purchase
1 30 for a transit plate for which a fee of ten dollars shall be
1 31 paid. And provided, however, that for any used vehicle held
1 32 by a registered dealer and not currently registered in this
1 33 state, or for any vehicle held by an individual and currently
1 34 registered in this state, when purchased in this state by a
1 35 nonresident for removal to the nonresident's state of
2 1 residence, the purchaser may make application to the county
2 2 treasurer in the county of purchase for a transit plate for
2 3 which a fee of three dollars shall be paid. The county
2 4 treasurer shall issue a nontransferable certificate of
2 5 registration for which no refund shall be allowed; and the
2 6 transit plates shall be void thirty days after issuance. Such
2 7 purchaser may apply for a certificate of title by surrendering
2 8 the manufacturer's or importer's certificate or certificate of
2 9 title, duly assigned as provided in this chapter. In this
2 10 event, the treasurer in the county of purchase shall, when
2 11 satisfied with the genuineness and regularity of the
2 12 application, and upon payment of a fee of ten dollars, issue a
2 13 certificate of title in the name and address of the
2 14 nonresident purchaser delivering the same to the person
2 15 entitled to the title as provided in this chapter. The
2 16 application requirements of section 321.20 apply to a title
2 17 issued as provided in this subsection, except that a natural
2 18 person who applies for a certificate of title shall provide
2 19 either the person's social security number, passport number,
2 20 or driver's license number, whether the license was issued by
2 21 this state, another state, or another country. The provisions
2 22 of this subsection relating to multipurpose vehicles are
2 23 effective January 1, 1993, for all 1993 and subsequent model
2 24 years. The annual registration fee for multipurpose vehicles
2 25 that are 1992 model years and older shall be in accordance
2 26 with section 321.124.
2 27 Sec. 3. NEW SECTION. 321.120 WORK TRUCKS.
2 28 The annual registration fee for a work truck shall be
2 29 computed pursuant to section 321.122, subsection 1, paragraph
2 30 "a" or "b". If the department determines by audit or other
2 31 means that a person who has registered a vehicle as a work
2 32 truck does not qualify for the registration, the person may be
2 33 required to pay regular registration fees for the vehicle
2 34 pursuant to section 321.109 in addition to any other penalty
2 35 or sanction imposed by law.
3 1 Sec. 4. Section 321.122, subsection 1, unnumbered
3 2 paragraph 1, Code 2005, is amended to read as follows:
3 3 The annual registration fee for truck tractors, road
3 4 tractors, and motor trucks, except motor trucks registered
3 5 under section 321.109 and motor trucks registered as special
3 6 trucks, shall be based on the combined gross weight of the
3 7 vehicle or combination of vehicles. All such trucks, truck
3 8 tractors, or road tractors shall be registered for a gross
3 9 weight equal to or in excess of the unladen weight of the
3 10 vehicle or combination of vehicles. The annual registration
3 11 fee for such vehicles or combination of vehicles, except motor
3 12 trucks registered under section 321.109 and special trucks,
3 13 shall be:
3 14 Sec. 5. Section 321.166, subsection 2, Code 2005, is
3 15 amended to read as follows:
3 16 2. Every registration plate or pair of plates shall
3 17 display a registration plate number which shall consist of
3 18 alphabetical or numerical characters or a combination thereof
3 19 and the name of this state, which may be abbreviated. Every
3 20 registration plate issued by the county treasurer shall
3 21 display the name of the county, including any plate issued
3 22 pursuant to section 321.34, except Pearl Harbor and purple
3 23 heart registration plates issued prior to January 1, 1997, and
3 24 collegiate, fire fighter, and congressional medal of honor
3 25 registration plates. Special truck registration plates shall
3 26 display the word "special". Work truck registration plates
3 27 shall display the word "work".
3 28 Sec. 6. APPLICABILITY. This Act applies to new motor
3 29 truck registrations and transfers of ownership effective on or
3 30 after July 1, 2006, and to registration renewals for
3 31 registration years beginning on or after July 1, 2006.
3 32 EXPLANATION
3 33 This bill requires certain motor trucks with an unladen
3 34 weight of less than 8,000 pounds to be registered for a fee
3 35 based on the weight and value of the vehicle in the manner
4 1 required for most other motor vehicles. Those trucks are
4 2 currently registered at a flat rate based on the combined
4 3 gross weight of the vehicle. The bill establishes a class of
4 4 motor trucks labeled "work trucks", which are defined as
4 5 trucks with an unladen weight of less than 8,000 pounds, owned
4 6 by a person engaged in farming or business and used for that
4 7 purpose. Vehicles that qualify as work trucks will continue
4 8 to be registered for a flat fee under the current formula and
4 9 will have the word "work" displayed on their registration
4 10 plates.
4 11 Motor trucks under 8,000 pounds, other than work trucks,
4 12 that are newly registered or that transfer ownership on or
4 13 after July 1, 2006, will be subject to the annual fee based on
4 14 weight and value. Motor trucks under 8,000 pounds, other than
4 15 work trucks, that are currently registered in Iowa will be
4 16 subject to the annual fee based on weight and value when their
4 17 registration is renewed for registration years beginning on or
4 18 after July 1, 2006.
