  1  1    Section 1.  Section 123.45, Code 2005, is amended by adding
  1  2 the following new unnumbered paragraph:
  1  3    NEW UNNUMBERED PARAGRAPH.  Notwithstanding any provision of
  1  4 this section to the contrary, the spouse of a person engaged
  1  5 in the business of manufacturing, bottling, or wholesaling
  1  6 alcoholic beverages, wine, or beer may be employed by a
  1  7 licensee or permittee authorized under this chapter to sell at
  1  8 retail if the employed spouse has no authority to directly or
  1  9 indirectly exercise control or influence over the management
  1 10 or operation of the employing retailer.
  1 11                           EXPLANATION
  1 12    This bill provides that the spouse of a person engaged in
  1 13 the business of manufacturing, bottling, or wholesaling
  1 14 alcohol may be employed by a licensee or permittee authorized
  1 15 to sell alcohol at retail if the spouse has no control over
  1 16 the management or operation of the retailer.
