1 1 Section 1. Section 321.460, Code 2005, is amended to read
1 2 as follows:
1 3 321.460 SPILLING LOADS ON HIGHWAYS.
1 4 1. A vehicle shall not be driven or moved on any highway
1 5 by any person unless such the vehicle is so constructed or
1 6 loaded or the load securely covered as to prevent any of its
1 7 the load from dropping, sifting, leaking, or otherwise
1 8 escaping or its the load covering from dropping from the
1 9 vehicle, except that sand may be dropped for the purpose of
1 10 securing traction, or water or other substance may be
1 11 sprinkled on a roadway in cleaning or maintaining such the
1 12 roadway. The provisions of this section subsection shall not
1 13 apply to vehicles loaded with hay or stover or the products
1 14 listed in section 321.466, subsections 5 and 6.
1 15 2. Notwithstanding subsection 1, a person shall not
1 16 operate or move a vehicle carrying rock or gravel on a highway
1 17 unless the load is covered in such a way as to prevent any of
1 18 the rock or gravel from escaping from the moving vehicle.
1 19 EXPLANATION
1 20 This bill requires that a vehicle carrying rock or gravel
1 21 must have its load covered to prevent any of the rock or
1 22 gravel from escaping the vehicle. A person who operates or
1 23 moves a vehicle on a highway in violation of this provision
1 24 commits a simple misdemeanor punishable by a scheduled fine of
1 25 $100.
