  1  1    Section 1.  Section 423.3, subsection 83, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    83.  The sales price from noncustomer point of sale or
  1  4 noncustomer automated teller machine access or service charges
  1  5 assessed by a financial institution.  For purposes of this
  1  6 subsection, "financial institution" means the same as defined
  1  7 in section 527.2.
  1  8                           EXPLANATION
  1  9    Present law exempts from the sales and use taxes the sales
  1 10 price from noncustomer point of sale or noncustomer automated
  1 11 teller machine access or service charges assessed by a
  1 12 financial institution.  This bill makes the exemption
  1 13 applicable to noncustomers and customers.
