1 An Act creating a support the arts motor vehicle registration
2 plate, establishing fees, and making an appropriation.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 303.88, Code 2005, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. Accept funds credited to the
1 4 department from the sale of support the arts motor vehicle
1 5 registration plates under section 321.34. Interest earned on
1 6 moneys accepted under this subsection shall be credited to the
1 7 division and is available for all or any of the purposes of
1 8 the division.
1 9 Sec. 2. Section 321.34, Code Supplement 2005, is amended
1 10 by adding the following new subsection:
1 11 NEW SUBSECTION. 24. SUPPORT THE ARTS PLATES.
1 12 a. Upon application and payment of the proper fees, the
1 13 director may issue support the arts plates to an owner of a
1 14 motor vehicle, trailer, or travel trailer registered in this
1 15 state.
1 16 b. Support the arts plates shall bear an emblem designed
1 17 by the department in consultation with the Iowa arts council.
1 18 c. The special fee for letter number designated support
1 19 the arts plates is thirty=five dollars. The fee for
1 20 personalized support the arts plates is twenty=five dollars,
1 21 which shall be paid in addition to the special support the
1 22 arts fee of thirty=five dollars. The fees collected by the
1 23 director under this subsection shall be paid monthly to the
1 24 treasurer of state and credited to the road use tax fund.
1 25 Notwithstanding section 423.43, and prior to the crediting of
1 26 revenues to the road use tax fund under section 423.43,
1 27 subsection 1, paragraph "b", the treasurer of state shall
1 28 transfer monthly from those revenues to the department of
1 29 cultural affairs the amount of the special fees collected in
1 30 the previous month for the support the arts plates. The funds
1 31 are appropriated to the department of cultural affairs to be
1 32 used to support programs administered by the arts division.
1 33 Notwithstanding section 8.33, moneys transferred under this
1 34 subsection shall not revert to the general fund of the state.
1 35 d. Upon receipt of the special registration plates, the
2 1 applicant shall surrender the current registration plates to
2 2 the county treasurer. The county treasurer shall validate the
2 3 special registration plates in the same manner as regular
2 4 registration plates are validated under this section. The
2 5 annual special support the arts fee for letter number
2 6 designated plates is ten dollars, which shall be paid in
2 7 addition to the regular annual registration fee. The annual
2 8 special fee for personalized support the arts plates is five
2 9 dollars, which shall be paid in addition to the annual special
2 10 support the arts fee and the regular annual registration fee.
2 11 The annual special support the arts fee shall be credited and
2 12 transferred as provided under paragraph "c".
2 13 EXPLANATION
2 14 This bill creates a special "support the arts" motor
2 15 vehicle registration plate bearing an emblem to be designed by
2 16 the state department of transportation in consultation with
2 17 the Iowa arts council. The plate is to be issued for a
2 18 special fee of $35, plus an additional $25 for a personalized
2 19 plate. The annual special renewal fee, which is in addition
2 20 to the regular annual registration fee for the vehicle, is
2 21 $10, plus an additional $5 for personalized plates. Moneys
2 22 from the $35 special plate issuance fee and the $10 special
2 23 plate renewal fee are appropriated to the department of
2 24 cultural affairs to support programs administered by the arts
2 25 division.
