2 sanitary districts.

1 1 Section 1. Section 358.12, unnumbered paragraph 1, Code
1 2 2005, is amended to read as follows:
1 3 The trustees elected as provided in section 358.9
1 4 constitute a board of trustees for the district by which they
1 5 are elected. The board of trustees is the corporate authority
1 6 of the sanitary district and shall manage and control the
1 7 affairs and property of the district. A majority of the board
1 8 of trustees shall constitute a quorum, but a smaller number
1 9 may adjourn from day to day. The board of trustees shall
1 10 elect a president, a clerk, and a treasurer from its
1 11 membership and may employ employees as necessary, who shall
1 12 hold their employment during the pleasure of the board. The
1 13 board shall prescribe the duties and fix the compensation of
1 14 all employees of the sanitary district and the amount of bond
1 15 to be filed by the treasurer of the district and by any
1 16 employee for whom the board may require bond. The members of
1 17 the board of trustees shall receive a per diem of forty one
1 18 hundred dollars for attendance at a meeting of the board or
1 19 while otherwise engaged in official duties, but the total per
1 20 diem for each member shall not exceed two thousand four
1 21 hundred dollars for a fiscal year. However, the board of
1 22 trustees, by resolution, may establish for its members a lower
1 23 rate of pay than is fixed by this section. The members of the
1 24 board shall also be reimbursed for their travel and other
1 25 necessary expenses incurred in performing their official
1 26 duties. Travel expenses are reimbursable at the rate
1 27 specified in section 70A.9.
1 28 EXPLANATION
1 29 This bill increases the amount of per diem, from $40 to
1 30 $100, that a trustee of a sanitary district may receive for
1 31 attending a board of trustees meeting or for being otherwise
1 32 engaged in trustee duties. The board of trustee may establish
1 33 by resolution a lower per diem amount. The $2,400 limit on
1 34 total per diem for each trustee per fiscal year still applies.
