  1  1    Section 1.  Section 321I.14, subsection 2, Code 2005, is
  1  2 amended to read as follows:
  1  3    2.  A person shall not operate or ride an all=terrain
  1  4 vehicle on public land with a firearm in the person's
  1  5 possession unless it is unloaded and enclosed in a carrying
  1  6 case.  However, a nonambulatory person may carry an uncased
  1  7 and unloaded firearm while operating or riding an all=terrain
  1  8 vehicle on public land.
  1  9                           EXPLANATION
  1 10    This bill prohibits a person from operating or riding an
  1 11 all=terrain vehicle on public land with a firearm in the
  1 12 person's possession unless it is unloaded and enclosed in a
  1 13 carrying case.  The bill further allows a nonambulatory person
  1 14 to carry an uncased and unloaded firearm while operating or
  1 15 riding an all=terrain vehicle on public land.
  1 16    A person who violates the bill is guilty of a simple
  1 17 misdemeanor pursuant to Code section 321I.15.  A simple
  1 18 misdemeanor is punishable by confinement for no more than 30
  1 19 days or a fine of at least $50 but not more than $500 or by
  1 20 both.
