  1  1                       UNCOMPENSATED CARE
  1  2    Section 1.  NEW SECTION.  135M.1  PATIENT INFORMATION
  1  3 REQUIRED == UNCOMPENSATED CARE == REPORTING INFORMATION.
  1  4    1.  An individual who is the recipient of health care
  1  5 services in a hospital and is uninsured shall disclose to the
  1  6 hospital the identity of the employer of the proposed
  1  7 beneficiary of health care benefits.  If the proposed
  1  8 beneficiary is employed, the proposed beneficiary shall also
  1  9 disclose whether the employment is full=time or part=time and
  1 10 the number of hours worked per week.  If the proposed
  1 11 beneficiary of health care benefits is not employed, the
  1 12 individual shall identify the employer of any adult who is
  1 13 responsible for providing support to the proposed beneficiary.
  1 14    2.  On or before January 1, 2007, and on or before January
  1 15 1 annually thereafter, each hospital shall submit a report to
  1 16 the department of human services providing the information
  1 17 collected under subsection 1 in a compiled format.  The
  1 18 reports submitted shall be used by the department of human
  1 19 services to compile the report required pursuant to section
  1 20 217.30A.  The department of human services shall adopt rules
  1 21 regarding the form to be used and the information to be
  1 22 collected under subsection 1.  Information collected shall not
  1 23 include the name of any individual proposed beneficiary and
  1 24 shall be collected in a manner that complies with all privacy
  1 25 standards established by state or federal law.
  1 26    3.  For purposes of this section, "proposed beneficiary"
  1 27 means an individual who receives health care services in a
  1 28 hospital who is uninsured or the person on whose behalf the
  1 29 individual receives health care benefits through the hospital,
  1 30 including but not limited to a child or other dependent of the
  1 31 individual.
  1 32    Sec. 2.  NEW SECTION.  217.30A  REPORT ON HEALTH CARE
  1 33 BENEFICIARIES.
  1 34    1.  On or before January 15, 2007, and on or before each
  1 35 January 15 annually thereafter, the department of human
  2  1 services shall submit a report to the governor and the general
  2  2 assembly specifying all employers identified pursuant to
  2  3 sections 135M.1, 249A.3A, 255.15A, and 514I.12 that, combined,
  2  4 employ twenty=five or more proposed beneficiaries as defined
  2  5 in those sections.  In determining whether an employer meets
  2  6 the threshold of employing twenty=five or more proposed
  2  7 beneficiaries, the department of human services shall include
  2  8 all proposed beneficiaries employed by the employer and its
  2  9 subsidiaries at all locations within the state.  The report
  2 10 shall include the name of the employer, the location of the
  2 11 employer, the total number of the employer's employees and
  2 12 dependents of employees who are proposed beneficiaries, and
  2 13 the total number of the employer's employees who are proposed
  2 14 beneficiaries that are employed full=time, the total number
  2 15 employed part=time, and the average number of hours worked by
  2 16 the employees per week.  The report shall also include the
  2 17 total cost to the state for providing health care benefits to
  2 18 the employees and dependents of the employees of the employers
  2 19 identified.  The report shall not include the name of any
  2 20 individual proposed beneficiary and shall comply with all
  2 21 privacy standards established by state or federal law.  The
  2 22 report shall also be made available to the public.
  2 23    2.  The department of human services shall adopt rules
  2 24 pursuant to chapter 17A to implement this section.
  2 25    Sec. 3.  NEW SECTION.  249A.3A  APPLICANT INFORMATION
  2 26 REQUIRED == REPORTING INFORMATION.
  2 27    1.  An applicant for the medical assistance program shall
  2 28 disclose the identity of the employer of the proposed
  2 29 beneficiary of health care benefits.  If the proposed
  2 30 beneficiary is employed, the proposed beneficiary shall also
  2 31 disclose whether the employment is full=time or part=time and
  2 32 the number of hours worked per week.  If the proposed
  2 33 beneficiary is not employed, the applicant shall identify the
  2 34 employer of any adult who is responsible for providing support
  2 35 to the proposed beneficiary.
  3  1    2.  On or before January 1, 2007, and on or before January
  3  2 1 annually thereafter, the department shall compile the
  3  3 information collected under subsection 1.  The information
  3  4 compiled shall be used by the department of human services to
  3  5 compile the report required pursuant to section 217.30A.  The
  3  6 department of human services shall adopt rules regarding the
  3  7 form to be used and the information to be collected under
  3  8 subsection 1.  Information collected shall not include the
  3  9 name of any individual proposed beneficiary and shall be
  3 10 collected in a manner that complies with all privacy standards
  3 11 established by state or federal law.
  3 12    3.  For the purposes of this section, "proposed
  3 13 beneficiary" means an individual who files an application for
  3 14 medical assistance for the individual or the person on whose
  3 15 behalf the individual files an application, including but not
  3 16 limited to a child or other dependent of the applicant or
  3 17 other individual for whom the application is filed.
  3 18    Sec. 4.  NEW SECTION.  255.15A  PATIENT INFORMATION
  3 19 REQUIRED == REPORTING INFORMATION.
  3 20    1.  Any patient admitted to the university of Iowa
  3 21 hospitals and clinics under this chapter shall disclose the
  3 22 identity of the employer of the proposed beneficiary of health
  3 23 care benefits.  If the proposed beneficiary is employed, the
  3 24 proposed beneficiary shall also disclose whether the
  3 25 employment is full=time or part=time and the number of hours
  3 26 worked per week.  If the proposed beneficiary of health care
  3 27 benefits is not employed, the individual shall identify the
  3 28 employer of any adult who is responsible for providing support
  3 29 to the proposed beneficiary.
  3 30    2.  On or before January 1, 2007, and on or before January
  3 31 1, annually thereafter, the university of Iowa hospitals and
  3 32 clinics shall submit a report to the department of human
  3 33 services providing the information collected under subsection
  3 34 1 in a compiled format.  The reports submitted shall be used
  3 35 by the department of human services to compile the report
  4  1 required pursuant to section 217.30A.  The department of human
  4  2 services shall adopt rules regarding the form to be used and
  4  3 the information to be collected under subsection 1.

  4  7 state or federal law.
  4  8    3.  For the purposes of this section, "proposed
  4  9 beneficiary" means an individual who receives health care
  4 10 services at the university of Iowa hospitals and clinics
  4 11 pursuant to this chapter or the person on whose behalf the
  4 12 individual receives health care benefits through the hospital,
  4 13 including but not limited to a child or other dependent of the
  4 14 individual.
  4 15    Sec. 5.  NEW SECTION.  514I.12  APPLICANT INFORMATION
  4 16 REQUIRED == REPORTING INFORMATION.
  4 17    1.  An applicant for the hawk=i program shall disclose the
  4 18 identity of the employer of the proposed beneficiary of health
  4 19 care benefits.  If the proposed beneficiary is employed, the
  4 20 proposed beneficiary shall also disclose whether the
  4 21 employment is full=time or part=time and the number of hours
  4 22 worked per week.  If the proposed beneficiary is not employed,
  4 23 the applicant shall identify the employer of any adult who is
  4 24 responsible for providing support to the proposed beneficiary.
  4 25    2.  On or before January 1, 2007, and on or before January
  4 26 1 annually thereafter, the department shall compile the
  4 27 information collected under subsection 1.  The information
  4 28 submitted shall be used by the department of human services to
  4 29 compile the report required pursuant to section 217.30A.  The

  5  1    3.  For the purposes of this section, "proposed
  5  2 beneficiary" means an individual who files an application for
  5  3 the hawk=i program for the individual or the person on whose
  5  4 behalf the individual files an application, including but not
  5  5 limited to a child or other dependent of the applicant or
  5  6 other individual for whom the application is filed.
  5  7    Sec. 6.  EFFECTIVE DATE.  This Act takes effect January 1,
  5  8 2006.
  5  9                           EXPLANATION
  5 10    This bill requires individuals who are the recipients of
  5 11 health care services in a hospital and are uninsured to
  5 12 disclose the identity of the employer of the proposed
  5 13 beneficiary of health care benefits.  If the proposed
  5 14 beneficiary is employed, the proposed beneficiary is also to
  5 15 disclose whether the employment is full=time or part=time and
  5 16 the number of hours worked per week.  If the proposed
  5 17 beneficiary of health care benefits is not employed, the
  5 18 individual is required to identify the employer of any adult
  5 19 who is responsible for providing support to the proposed
  5 20 beneficiary.  The bill also requires that an applicant for the
  5 21 medical assistance program, the indigent patient program, or
  5 22 the hawk=i program disclose the identity of the employer of
  5 23 the proposed beneficiary of health care benefits.  If the
  5 24 proposed beneficiary is employed, the proposed beneficiary is
  5 25 also to disclose whether the employment is full=time or part=
  5 26 time and the number of hours worked per week.  If the proposed
  5 27 beneficiary is not employed, the applicant is required to
  5 28 identify the employer of any adult who is responsible for
  5 29 providing support to the proposed beneficiary.  The required
  5 30 provision of information is to begin January 1, 2006.
  5 31    The bill provides that on or before January 1, 2007, and on
  5 32 or before January 1 annually thereafter, each hospital is
  5 33 required to compile the information submitted by individuals
  5 34 regarding employers and submit a report of this information to
  5 35 the department of human services.  Additionally, on or before
  6  1 January 1, 2007, and on or before January 1 annually
  6  2 thereafter, the information submitted by applicants for
  6  3 medical assistance, the indigent patient program, or the hawk=
  6  4 i program regarding employers is to be compiled by the
  6  5 department of human services.
  6  6    The bill then provides that beginning January 15, 2007, and
  6  7 each January 15 annually thereafter, the department of human
  6  8 services is to submit a report to the governor and the general
  6  9 assembly specifying all employers identified by hospitals or
  6 10 the Medicaid, indigent patient, or hawk=i programs that,
  6 11 combined, employ 25 or more proposed beneficiaries.  The
  6 12 report is to include the name of the employer, the location of
  6 13 the employer, the total number of the employer's employees and
  6 14 dependents of employees who are proposed beneficiaries, and
  6 15 the total number of the employer's employees who are proposed
  6 16 beneficiaries who are employed full=time and part=time, and
  6 17 the average number of hours worked per week.  The report is
  6 18 also to include the total cost to the state for providing
  6 19 health care benefits to the employees and dependents of the
  6 20 employees of the employers identified.  The report is not to
  6 21 include the names of any individual proposed beneficiary and
  6 22 is also to comply with all privacy standards established by
  6 23 state or federal law.  The bill also provides that the report
  6 24 is to be made available to the public.
  6 25    The bill takes effect January 1, 2006.
