1 An Act permitting certain poker and euchre contests to be
2 conducted by qualified organizations.

1 1 Section 1. Section 99B.7, subsection 1, unnumbered
1 2 paragraph 1, Code 2005, is amended to read as follows:
1 3 Except as otherwise provided in section 99B.8 or 99B.8A,
1 4 games of skill, games of chance, and raffles lawfully may be
1 5 conducted at a specified location meeting the requirements of
1 6 subsection 2 of this section, but only if all of the following
1 7 are complied with:
1 8 Sec. 2. NEW SECTION. 99B.8A POKER AND EUCHRE CONTESTS.
1 9 1. A poker or euchre contest lawfully may be conducted
1 10 during a period of twenty=four consecutive hours no more than
1 11 twelve times each calendar year by a qualified organization
1 12 also licensed under section 99B.7. The poker or euchre
1 13 contest may be conducted at any location except one for which
1 14 a license is required pursuant to section 99B.3 or section
1 15 99B.5, but only if all of the following are complied with:
1 16 a. The sponsor of the event has been issued a license
1 17 pursuant to subsection 3 and prominently displays that license
1 18 on the premises covered by the license.
1 19 b. During the entire time activities permitted by this
1 20 section are being engaged in, no other gambling is engaged in
1 21 at the same location.
1 22 c. A participant shall not win or lose more than a total
1 23 of three hundred dollars or other consideration equivalent
1 24 thereto in one or more games of poker or euchre at any time
1 25 during any period of twenty=four consecutive hours or over
1 26 that entire period in which a poker or euchre contest is
1 27 conducted. For the purpose of this paragraph, the total
1 28 amount a person wins or loses in any game, wager, or bet shall
1 29 be determined regardless of any amount that person may have
1 30 contributed to the amount at stake.
1 31 2. The sponsor of a poker or euchre contest may charge an
1 32 entrance fee or a fee to participate in the games, and
1 33 participants may pay an entrance or other fee for
1 34 participation, provided that a participant may not expend more
1 35 than a total of three hundred dollars for all fees. The
2 1 provisions of section 99B.7, subsection 3, paragraphs "b" and
2 2 "c", shall apply to poker and euchre contests conducted by a
2 3 qualified organization pursuant to this section.
2 4 3. The department of inspections and appeals may issue a
2 5 license pursuant to this section pursuant to rules adopted by
2 6 the department. The license may be issued only upon
2 7 submission to the department of an application and a license
2 8 fee of twenty=five dollars.
2 9 Sec. 3. Section 99B.9, subsection 1, unnumbered paragraph
2 10 1, Code 2005, is amended to read as follows:
2 11 Except as otherwise permitted by section 99B.3, 99B.5,
2 12 99B.6, 99B.7, 99B.8, 99B.8A, 99B.11, or 99B.12A, it is
2 13 unlawful to permit gambling on any premises owned, leased,
2 14 rented, or otherwise occupied by a person other than a
2 15 government, governmental agency, or governmental subdivision,
2 16 unless all of the following are complied with:
2 17 Sec. 4. Section 99B.12, subsection 1, unnumbered paragraph
2 18 1, Code 2005, is amended to read as follows:
2 19 Except in instances where because of the location of the
2 20 game or the circumstances of the game section 99B.3, section
2 21 99B.5, section 99B.6, section 99B.7, section 99B.8, section
2 22 99B.8A, or section 99B.9 is applicable, individuals may
2 23 participate in gambling specified in subsection 2, but only if
2 24 all of the following are complied with:
2 25 EXPLANATION
2 26 This bill provides that a qualified organization licensed
2 27 under Code section 99B.7 may conduct up to 12 poker and euchre
2 28 contests in a calendar year. The bill requires the qualified
2 29 organization to pay a $25 license fee to conduct the contests.
2 30 The bill provides that, to be lawful, a participant in a poker
2 31 or euchre contest cannot lose or win more than $300 in a 24=
2 32 hour period and may pay no more than $300 in entrance fees.
