  1  1    Section 1.  Section 15E.193, Code 2005, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  2A.  A business that has initiated a
  1  4 project prior to the establishment of an enterprise zone shall
  1  5 be eligible to receive incentives and assistance under this
  1  6 division provided that the project has not been completed
  1  7 prior to the establishment of the enterprise zone in which the
  1  8 business is located and provided that the business meets all
  1  9 other criteria provided for in this section.
  1 10    Sec. 2.  EFFECTIVE AND RETROACTIVE APPLICABILITY DATES.
  1 11 This Act, being deemed of immediate importance, takes effect
  1 12 upon enactment and applies retroactively to July 1, 2001.
  1 13                           EXPLANATION
  1 14    This bill relates to criteria for eligible businesses under
  1 15 the enterprise zone program.
  1 16    The bill provides that a business that has initiated a
  1 17 project prior to the establishment of an enterprise zone shall
  1 18 be eligible to receive incentives and assistance under the
  1 19 enterprise zone program provided that the project has not been
  1 20 completed prior to the establishment of the enterprise zone in
  1 21 which the business is located and provided that the business
  1 22 meets all other criteria provided for under the program.
  1 23    The bill takes effect upon enactment and applies
  1 24 retroactively to July 1, 2001.
