  1  1          SENATE CONCURRENT RESOLUTION NO.    
  1  2                 BY  MILLER and KREIMAN
  1  3 A Concurrent Resolution relating to the creation of a
  1  4    criminal code revisions legislative study committee.
  1  5    WHEREAS, a need exists to review, reorganize,
  1  6 update, and revise the criminal code; and
  1  7    WHEREAS, current criminal penalties and sentencing
  1  8 practices should be reviewed, including but not
  1  9 limited to the effects of mandatory minimum penalties,
  1 10 limitations on parole, and sentence enhancements; and
  1 11    WHEREAS, a comparative assessment should be
  1 12 conducted of the relative penalties imposed for
  1 13 various crimes, based not only on the threat posed by
  1 14 the prohibited conduct, but also the risk associated
  1 15 with particular criminal offenders; NOW THEREFORE,
  1 16    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  1 17 REPRESENTATIVES CONCURRING, That the legislative
  1 18 council establish an interim study committee to study,
  1 19 review, reorganize, update, and revise the criminal
  1 20 code; and
  1 21    BE IT FURTHER RESOLVED, That the committee shall
  1 22 consist of fifteen members with each organization
  1 23 selecting their members as follows:
  1 24    1.  One member to be selected by the democratic
  1 25 floor leader of the senate.
  1 26    2.  One member to be selected by the republican
  1 27 floor leader of the senate.
  1 28    3.  One member to be selected by the speaker of the
  1 29 house of representatives.
  1 30    4.  One member to be selected by the minority
  2  1 leader of the house of representatives.
  2  2    5.  One member from the department of corrections.
  2  3    6.  One member from the board of parole.
  2  4    7.  One member from a judicial district department
  2  5 of correctional services chosen by a majority of the
  2  6 directors of the district departments.
  2  7    8.  One member from the department of justice.
  2  8    9.  One member from the Iowa defense counsel
  2  9 association.
  2 10    10.  Two members of the Iowa state bar association.
  2 11    11.  Two members of the Iowa county attorneys
  2 12 association.
  2 13    12.  Two members of the Iowa judges association;
  2 14 and
  2 15    BE IT FURTHER RESOLVED, That the committee shall
  2 16 submit a status report to the general assembly by
  2 17 January 15, 2006.
