2 renewable fuel infrastructure, and providing for a contingent
3 effective date.

1 1 Section 1. Section 15G.111, subsection 1, paragraph a,
1 2 Code Supplement 2005, is amended to read as follows:
1 3 a. For the fiscal period beginning July 1, 2005, and
1 4 ending June 30, 2015, there is appropriated each fiscal year
1 5 from the grow Iowa values fund created in section 15G.108, to
1 6 the following amounts for the purposes designated:
1 7 (1) (a) For the fiscal year beginning July 1, 2005, and
1 8 ending June 30, 2006, to the department of economic
1 9 development thirty=five million dollars for programs
1 10 administered by the department of economic development.
1 11 (b) This subparagraph (1) is repealed on July 1, 2006.
1 12 (2) (a) For each fiscal year of the fiscal period
1 13 beginning July 1, 2006, and ending June 30, 2009, to the
1 14 department of economic development thirty=three million
1 15 dollars for programs administered by the department of
1 16 economic development.
1 17 (b) This subparagraph (2) is repealed on July 1, 2009.
1 18 (3) (a) For each fiscal year of the fiscal period
1 19 beginning July 1, 2009, and ending June 30, 2015, to the
1 20 department of economic development thirty=five million dollars
1 21 for programs administered by the department of economic
1 22 development.
1 23 (b) This subparagraph (3) is repealed on July 1, 2015.
1 24 Sec. 2. Section 15G.111, Code Supplement 2005, is amended
1 25 by adding the following new subsection:
1 26 NEW SUBSECTION. 6A. a. For the fiscal period beginning
1 27 July 1, 2006, and ending June 30, 2009, there is appropriated
1 28 each fiscal year from the grow Iowa values fund created in
1 29 section 15G.108 to the department of natural resources two
1 30 million dollars for deposit in the renewable fuel
1 31 infrastructure fund as enacted in 2006 Iowa Acts, House File
1 32 2735, to be expended as provided in that Act.
1 33 b. This subsection is repealed on July 1, 2009.
1 34 Sec. 3. CONTINGENT EFFECTIVE DATE. This Act is contingent
1 35 upon the establishment of a renewable fuel infrastructure fund
2 1 as enacted in 2006 Iowa Acts, House File 2735.
2 2 EXPLANATION
2 3 This bill is related to H.F. 2735, which is pending in the
2 4 general assembly, providing for the formulation of motor fuel
2 5 by providing for renewable fuel, including ethanol blended
2 6 fuel and biodiesel blended fuel. Part of that bill
2 7 establishes a renewable fuel infrastructure fund. The fund is
2 8 under the control of the department of natural resources to be
2 9 allocated between supporting infrastructure relating to the
2 10 storage and dispensing of E=85 gasoline at service stations
2 11 and biodiesel at terminals. The purpose of the renewable fuel
2 12 infrastructure program for service stations is to provide
2 13 cost=share financial assistance to service stations
2 14 installing, replacing, or converting motor fuel storage and
2 15 dispensing infrastructure designed and used exclusively for E=
2 16 85 gasoline, biodiesel, or biodiesel blended fuel. The
2 17 purpose of the renewable fuel infrastructure program for
2 18 biodiesel terminal facilities is to provide cost=share
2 19 financial assistance to support infrastructure designed and
2 20 used exclusively to store and distribute biodiesel or
2 21 biodiesel blended fuel.
2 22 Code section 15G.110 creates a standing general fund
2 23 appropriation to the Iowa values fund of $50 million for each
2 24 fiscal year beginning July 1, 2005, and ending June 30, 2015,
2 25 to support a number of entities, including the Iowa department
2 26 of economic development, which annually receives $35 million
2 27 of that amount. A percentage of that amount is to be used for
2 28 a variety of purposes such as business start=ups, expansions,
2 29 modernization, attraction, retention, marketing, and research
2 30 and development.
2 31 The bill appropriates $2 million from the Iowa values fund
2 32 for each fiscal year beginning July 1, 2006, and ending June
2 33 30, 2009, to the department of natural resources for deposit
2 34 into the renewable fuel infrastructure fund, and reduces the
2 35 same amount which would otherwise be allocated to the Iowa
3 1 department of economic development.
3 2 The bill takes effect only if the renewable fuel
3 3 infrastructure fund as established in H.F. 2735 is enacted.
