1 An Act relating to the filing of reports and statements with the
2 ethics and campaign disclosure board and the use of certain
3 resources for political campaign purposes.

1 1 Section 1. Section 68A.402, subsection 1, Code Supplement
1 2 2005, is amended to read as follows:
1 3 1. FILING METHODS. Each committee shall file with the
1 4 board reports disclosing information required under this
1 5 section on forms prescribed by rule. Reports shall be filed
1 6 on or before the required due dates by using any of the
1 7 following methods: mail bearing a United States postal
1 8 service postmark, hand=delivery, facsimile transmission, or
1 9 electronic filing as prescribed by rule. A report that is
1 10 required to be filed five days before an election must be
1 11 physically received by the board to be considered timely
1 12 filed. This requirement does not apply to a supplementary
1 13 report under subsection 2, paragraph "b".
1 14 Sec. 2. Section 68A.503, subsection 2, Code Supplement
1 15 2005, is amended to read as follows:
1 16 2. Except as provided in subsection 3, it is unlawful for
1 17 a member of a committee, or its employee or representative,
1 18 except a ballot issue committee, or for a candidate for office
1 19 or the representative of the candidate, to solicit, request,
1 20 or knowingly receive from an insurance company, savings and
1 21 loan association, bank, credit union, or corporation organized
1 22 pursuant to the laws of this state, the United States, or any
1 23 other state, territory, or foreign country, whether for profit
1 24 or not, or its officer, agent, or representative, any money,
1 25 property, or thing of value belonging to the insurance
1 26 company, savings and loan association, bank, or corporation
1 27 for campaign expenses, or to expressly advocate that the vote
1 28 of an elector be used to nominate, elect, or defeat a
1 29 candidate for public office. This section does not restrain
1 30 or abridge the freedom of the press or prohibit the
1 31 consideration and discussion in the press of candidacies,
1 32 nominations, public officers, or public questions. The board
1 33 shall adopt rules concerning the use of resources belonging to
1 34 an incorporated media organization where the publisher, owner,
1 35 or editor of the incorporated media organization is a
2 1 candidate for public office.
2 2 EXPLANATION
2 3 This bill makes a number of revisions to Iowa's campaign
2 4 disclosure=income tax checkoff Act. With the exception of
2 5 certain supplementary reports, any other report which is
2 6 required to be filed five days prior to an election must be
2 7 physically received to be considered timely filed. A second
2 8 revision requires the ethics and campaign disclosure board to
2 9 adopt rules relating to the use of resources belonging to an
2 10 incorporated media organization when the publisher, owner, or
2 11 editor of the organization is a candidate.
