Section 80.24, Code Supplement 2005, is amended 1 2 to read as follows: 1 3 80.24MUNICIPAL ANDINDUSTRIAL DISPUTES. 1 4 A peace officer of the department shall not be used or 1 5 called upon for service within any municipalityor in any1 6 involving an industrial dispute unless a threat of imminent 1 7 violence exists, and then only either by order of the governor 1 8 or on the request of the chief executive officer of the 1 9 municipality or the sheriff of the county where the threat of 1 10 imminent violence exists if such request is approved by the 1 11 governor. 1 12 Sec. 2. CODE EDITOR DIRECTIVE. The Code editor is 1 13 directed to change the term "bureau of criminal 1 14 identification" or "bureau" to "division of criminal 1 15 investigation" or "division" wherever the term appears in the 1 16 Code or in the Acts pending codification. 1 17 Sec. 3. EFFECTIVE DATE. The section of this Act amending 1 18 section 80.24, being deemed of immediate importance, takes 1 19 effect upon enactment. 1 20 EXPLANATION 1 21 This bill relates to the use of a peace officer of the 1 22 department of public safety in an industrial dispute. 1 23 The bill provides that a peace officer of the department of 1 24 public safety shall not be called upon for service within any 1 25 municipality involving an industrial dispute unless a threat 1 26 of imminent violence exists and the governor approves the use 1 27 of such peace officers in the dispute. 1 28 Current law provides that a peace officer of the department 1 29 of public safety shall not be called upon for service within 1 30 any municipality or in any industrial dispute unless a threat 1 31 of imminent violence exists and the governor approves the use 1 32 of such peace officers in the municipality or dispute. 1 33 The section of the bill amending the use of peace officers 1 34 of the department of public safety in an industrial dispute 1 35 takes effect upon enactment. 2 1 LSB 5380XD 81 2 2 jm:rj/cf/24
