1 An Act relating to the operation of a motor vehicle by a person
2 with a special minor's license, and providing penalties.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 321.194, subsection 1, paragraph a,
1 2 Code Supplement 2005, is amended by adding the following new
1 3 unnumbered paragraph:
1 4 NEW UNNUMBERED PARAGRAPH. A person licensed under this
1 5 section shall not operate a motor vehicle carrying passengers
1 6 other than persons qualified to accompany a permittee under
1 7 section 321.180B, subsection 1.
1 8 Sec. 2. Section 321.194, Code Supplement 2005, is amended
1 9 by adding the following new subsection:
1 10 NEW SUBSECTION. 1A. A person who is licensed under this
1 11 section shall be issued a sticker to be affixed on the lower
1 12 left side of the rear window of the motor vehicle operated by
1 13 the licensee. The sticker shall be fluorescent yellow=green
1 14 in color, bear the words "school license", and bear an
1 15 identifying number determined by the department. A licensee
1 16 may be issued more than one sticker as determined by the
1 17 department by rule. A person who is licensed to drive under
1 18 this section shall not operate a motor vehicle that is not
1 19 clearly displaying the sticker required under this subsection.
1 20 Sec. 3. Section 321.194, subsection 2, Code Supplement
1 21 2005, is amended to read as follows:
1 22 2. SUSPENSION, AND REVOCATION, AND CANCELLATION.
1 23 a. A driver's license issued under this section is subject
1 24 to suspension or revocation for the same reasons and in the
1 25 same manner as suspension or revocation of any other driver's
1 26 license. The department may also suspend a driver's license
1 27 issued under this section upon receiving satisfactory evidence
1 28 that the licensee has violated the restrictions of the license
1 29 or has been involved in one or more accidents chargeable to
1 30 the licensee. The department may suspend a driver's license
1 31 issued under this section upon receiving a record of the
1 32 licensee's conviction for one violation. The department shall
1 33 revoke the license upon receiving a record of conviction for
1 34 two or more violations of a law of this state or a city
1 35 ordinance regulating the operation of motor vehicles on
2 1 highways other than parking violations as defined in section
2 2 321.210. After a person licensed under this section receives
2 3 two or more convictions which require revocation of the
2 4 person's license under this section, the department shall not
2 5 grant an application for a new driver's license until the
2 6 expiration of one year.
2 7 b. The department shall immediately cancel a license
2 8 issued under this section upon receiving satisfactory evidence
2 9 that the licensee has violated the provisions of subsection
2 10 1A. A person whose license is canceled under this paragraph
2 11 shall not be issued another license under this section.
2 12 EXPLANATION
2 13 This bill requires a motor vehicle operator who holds a
2 14 special minor's license to display a sticker on the lower left
2 15 side of the rear window of the vehicle. The sticker is to be
2 16 fluorescent yellow=green and bear the words "school license"
2 17 and an identifying number determined by the state department
2 18 of transportation. The department has the discretion to issue
2 19 more than one sticker to a licensee.
2 20 The bill requires the department to immediately cancel the
2 21 special minor's license of a person who operates a vehicle not
2 22 clearly displaying the school license sticker, and such person
2 23 shall not be issued another special minor's license.
2 24 Current law provides that a special minor's license may be
2 25 issued to a person between 14 and 18 years of age to drive to
2 26 and from school, or the nearest bus stop, and certain school
2 27 activities within the school district between the hours of 6
2 28 a.m. and 10 p.m. In addition, the licensee may drive at any
2 29 time when accompanied by a person with a valid driver's
2 30 license who is the driver's parent or guardian, an immediate
2 31 family member at least 21 years of age, a driver education
2 32 instructor, or a person at least 25 years of age with written
2 33 permission of the parent or guardian. The bill prohibits a
2 34 person with a special minor's license from operating a motor
2 35 vehicle at any time when there are passengers in the vehicle
3 1 other than such qualified accompanying adults. A person who
3 2 violates the restrictions of a special minor's license is
3 3 subject to sanctions including suspension or revocation of the
3 4 license.
