1 1 Section 1. Section 437A.15, subsection 7, Code 2005, is
1 2 amended to read as follows:
1 3 7. The department of management, in consultation with the
1 4 department of revenue, shall coordinate the utility
1 5 replacement tax task force and provide staffing assistance to
1 6 the task force. It is the intent of the general assembly that
1 7 the task force include representatives of the department of
1 8 management, department of revenue, electric companies, natural
1 9 gas companies, municipal utilities, electric cooperatives,
1 10 counties, cities, school boards, and industrial, commercial,
1 11 and residential consumers, and other appropriate stakeholders.
1 12 The director of the department of management and the director
1 13 of revenue shall serve as cochairpersons of the task force.
1 14 The task force shall study the effects of the replacement
1 15 tax on local taxing authorities, local taxing districts,
1 16 consumers, and taxpayers and the department of management
1 17 shall report to the general assembly by January 1 of each year
1 18 through January 1, 2005, the results of the study and the
1 19 specific recommendations of the task force for modifications
1 20 to the replacement tax, if any, which will further the
1 21 purposes of tax neutrality for local taxing authorities, local
1 22 taxing districts, taxpayers, and consumers, consistent with
1 23 the stated purposes of this chapter. The department of
1 24 management shall also report to the legislative council by
1 25 November 15 of each year through 2004, the status of the task
1 26 force study and any recommendations through January 1, 2008.
1 27 If the task force recommends modifications to the replacement
1 28 tax that will further the purposes of tax neutrality for local
1 29 taxing authorities, local taxing districts, taxpayers, and
1 30 consumers, consistent with the stated purposes of this
1 31 chapter, the department of management shall transmit those
1 32 recommendations to the general assembly.
1 33 EXPLANATION
1 34 This bill amends Code subsection 437A.15(7) to extend the
1 35 utility replacement tax task force through January 1, 2008.
2 1 The bill also designates the director of the department of
2 2 management and the director of revenue as cochairpersons of
2 3 the task force. Specific recommendations from the task force
2 4 for modifications to the replacement tax are to be transmitted
2 5 to the general assembly by the department of management.
