1 An Act relating to electronic notices of bidding opportunities
2 for state purchases and of any extension or renewal of
3 existing contracts.

1 1 Section 1. Section 8A.311, subsection 1, Code 2005, is
1 2 amended to read as follows:
1 3 1. a. All equipment, supplies, or services procured by
1 4 the department shall be purchased by a competitive bidding
1 5 procedure as established by rule. However, the director may
1 6 exempt by rule purchases of noncompetitive items and purchases
1 7 in lots or quantities too small to be effectively purchased by
1 8 competitive bidding. Preference shall be given to purchasing
1 9 Iowa products and purchases from Iowa=based businesses if the
1 10 Iowa=based business bids submitted are comparable in price to
1 11 bids submitted by out=of=state businesses and otherwise meet
1 12 the required specifications. If the laws of another state
1 13 mandate a percentage preference for businesses or products
1 14 from that state and the effect of the preference is that bids
1 15 of Iowa businesses or products that are otherwise low and
1 16 responsive are not selected in the other state, the same
1 17 percentage preference shall be applied to Iowa businesses and
1 18 products when businesses or products from that other state are
1 19 bid to supply Iowa requirements.
1 20 b. The department and each state agency shall provide
1 21 notice in an electronic format available to the public of
1 22 every competitive bidding opportunity and notice of every
1 23 extension or renewal of an existing contract offered by the
1 24 department or the state agency. The department may establish
1 25 by rule requirements relating to the electronic notices. The
1 26 electronic notice requirement does not apply to architectural
1 27 and engineering services procured under subsection 3,
1 28 paragraph "b".
1 29 EXPLANATION
1 30 This bill requires the department of administrative
1 31 services to make all competitive bidding opportunities and
1 32 notices of extensions or renewals of existing contracts, from
1 33 all state executive branch agencies, available to the public
1 34 in an electronic format. The notice requirement does not
1 35 apply to architectural and engineering services procured using
2 1 the procedures set out in Code section 8A.311, subsection 3,
2 2 paragraph "b".
