House Resolution 48 - Introduced PAG LIN 1 1 HOUSE RESOLUTION NO. 1 2 BY COMMITTEE ON ETHICS 1 3 (SUCCESSOR TO HSB 300) 1 4 A Resolution amending the House code of ethics. 1 5 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 1 6 That Rule 12, paragraph c, of the House Code of 1 7 Ethics, as adopted by the House of Representatives 1 8 during the 2005 Session in House Resolution 7, is 1 9 amended to read as follows: 1 10 c. Form and contents of complaint. A complaint 1 11 shall be in writing. 1 12 Complaint forms shall be available from the chief 1 13 clerk of the house, but a complaint shall not be 1 14 rejected for failure to use the approved form if it 1 15 complies with the requirements of these rules. The 1 16 complaint shall contain a certification made by the 1 17 complainant, under penalty of perjury, that the facts 1 18 stated in the complaint are true to the best of the 1 19 complainant's knowledge. 1 20 To be valid, a complaint shall allege all of the 1 21 following: 1 22 (1) Facts,including the approximate date and 1 23 location of any event, incident, or transaction that,1 24 that if true, establish a violation of a provision of 1 25 chapter 68B of the Code, the house code of ethics, or 1 26 house rules governing lobbyists for which penalties or 1 27 other remedies are provided. 1 28 (2) That the conduct providing the basis for the 1 29 complaint occurred within three years of the filing of 1 30 the complaint. 2 1 (3) That the party charged with a violation is a 2 2member or employee of the house, a lobbyist, or a 2 3 client of a lobbyistparty subject to the jurisdiction 2 4 of the ethics committee. 2 5 LSB 3596HV 81 2 6 tm:rj/gg/14 1
