House Resolution 125 - Introduced PAG LIN 1 1 HOUSE RESOLUTION NO. 1 2 BY ALONS, KURTENBACH, CARROLL, and WATTS 1 3 A Resolution urging the United States Congress to repeal 1 4 legislation which preempts state laws relating to the 1 5 mercury content of vaccines. 1 6 WHEREAS, the United States Congress enacted as part 1 7 of the Department of Defense Appropriations bill for 1 8 the fiscal year ending September 30, 2006, Pub. L. No. 1 9 109=148, the Public Readiness and Emergency 1 10 Preparedness Act; and 1 11 WHEREAS, the Public Readiness and Emergency 1 12 Preparedness Act grants immunity to drug companies 1 13 from liability for injuries caused by their products 1 14 if the Secretary of Health and Human Services declares 1 15 these products to be covered countermeasures; and 1 16 WHEREAS, the legislation preempts any state law 1 17 which conflicts with a covered countermeasure; and 1 18 WHEREAS, in the case of a covered countermeasure 1 19 which is a vaccine, the legislation preempts state 1 20 legislation prohibiting or limiting the formulation of 1 21 the vaccine including the use of the mercury= 1 22 containing preservative thimerosal; and 1 23 WHEREAS, Iowa law limits the use of mercury in 1 24 vaccines; NOW THEREFORE, 1 25 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 1 26 That the House of Representatives urges the United 1 27 States Congress to pass, and the President to sign, 1 28 legislation repealing the Public Readiness and 1 29 Emergency Preparedness Act in order to allow Iowa and 1 30 other states to limit the use of mercury=containing 2 1 preservatives in vaccines and to continue to protect 2 2 and follow the will of their own citizens. 2 3 LSB 6264YH 81 2 4 pf:nh/je/5 1
