  1  3 A Resolution relating to expediting the process for
  1  4    identifying a deceased person.
  1  5    WHEREAS, it is essential that the identification of
  1  6 a deceased person occur as quickly as possible; and
  1  7    WHEREAS, as soon as a deceased person is
  1  8 identified, it is critically important that the
  1  9 deceased person's family be immediately notified about
  1 10 the death of the person; NOW THEREFORE,
  1 11    BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES,
  1 12 That the Attorney General is requested to assemble a
  1 13 group to collaboratively develop and propose a law,
  1 14 rule, or policy, applicable on a statewide basis, that
  1 15 establishes a process and assigns responsibilities to
  1 16 various agencies and departments at both the state and
  1 17 local level to assist a person seeking additional
  1 18 information about the identity of a deceased person
  1 19 and whose death requires an investigation by a law
  1 20 enforcement agency or medical examiner, so that
  1 21 identification of the deceased person can be
  1 22 determined as soon as possible.  In developing the new
  1 23 law, rule, or policy, the Attorney General shall
  1 24 collaborate with the Department of Public Safety, the
  1 25 State Medical Examiner, the Interagency Coordinating
  1 26 Council, the Tama County medical examiner, the Tama
  1 27 County sheriff, county medical examiners, police
  1 28 chiefs, victim services organizations, funeral home
  1 29 directors, the media, the faith community, and persons
  1 30 who have received death notifications; and
  2  1    BE IT FURTHER RESOLVED, That the new law, rule, or
  2  2 policy shall address the proper evidence to be
  2  3 collected from the deceased person and the scene
  2  4 around such a person to expedite the identification
  2  5 process, how any collected evidence is to be used to
  2  6 collect additional identifying information, who shall
  2  7 be involved in making the decision to seek additional
  2  8 information, and who shall be assigned to collect and
  2  9 disclose such information; and
  2 10    BE IT FURTHER RESOLVED, That the new law, rule, or
  2 11 policy shall consider what agency or department should
  2 12 be contacted in the event an unidentified deceased
  2 13 person is discovered, who is responsible for
  2 14 contacting such agencies or departments, and what
  2 15 documents or records should be examined by the
  2 16 contacted agencies or departments; and
  2 17    BE IT FURTHER RESOLVED, That the new law, rule, or
  2 18 policy shall determine who shall contact any suspected
  2 19 family members of the deceased person or any other
  2 20 person who may identify the deceased person, and when
  2 21 and how such contact should take place; and
  2 22    BE IT FURTHER RESOLVED, That the new law, rule, or
  2 23 policy shall determine how and when the deceased
  2 24 person should be viewed by the suspected family
  2 25 members of the deceased person or any other person in
  2 26 order to identify the deceased person; and
  2 27    BE IT FURTHER RESOLVED, That the new law, rule, or
  2 28 policy shall address how the decision is made that the
  2 29 deceased person has been sufficiently identified so
  2 30 the death notification process can commence; and
  3  1    BE IT FURTHER RESOLVED, That the proposed law,
  3  2 rule, or policy shall establish a process for
  3  3 notifying family members, in a timely and dignified
  3  4 manner, of the death of a person when the death
  3  5 requires an investigation by a law enforcement agency
  3  6 or medical examiner.
