House Resolution 112 - Introduced PAG LIN 1 1 HOUSE RESOLUTION NO. 1 2 BY JOCHUM, MASCHER, LENSING, WINCKLER, 1 3 and WESSEL=KROESCHELL 1 4 A Resolution urging the United States Congress to 1 5 authorize the United States Food and Drug 1 6 Administration to regulate tobacco products. 1 7 WHEREAS, according to the campaign for tobacco=free 1 8 kids, tobacco use remains the nation's leading 1 9 preventable cause of death, killing more than 400,000 1 10 people annually; and 1 11 WHEREAS, the centers for disease control and 1 12 prevention of the United States Department of Health 1 13 and Human Services estimate that tobacco use causes 1 14 over $89 billion in annual health care expenditures, 1 15 including over $28 billion in total annual Medicaid 1 16 costs; and 1 17 WHEREAS, to date, efforts to restrict advertising 1 18 and marketing of tobacco products have failed to 1 19 substantially reduce the use of tobacco products, 1 20 especially by children; and 1 21 WHEREAS, the state and federal governments have 1 22 lacked the legal and regulatory authority to 1 23 comprehensively address the public health problems 1 24 caused by the use of tobacco products; and 1 25 WHEREAS, the sale, distribution, marketing, 1 26 advertising, and use of tobacco products are 1 27 activities that involve and substantially affect 1 28 interstate commerce; and 1 29 WHEREAS, it is in the public interest to authorize 1 30 the United States Food and Drug Administration to 2 1 regulate tobacco products; and 2 2 WHEREAS, such authority would include, but not be 2 3 limited to, the authority to regulate the levels of 2 4 tar, nicotine, and other harmful components of tobacco 2 5 products, to regulate the advertising and promotion of 2 6 tobacco products so that consumers are better 2 7 informed, and to ensure effective oversight of the 2 8 tobacco industry's efforts to develop, introduce, and 2 9 promote less harmful tobacco products; NOW THEREFORE, 2 10 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, 2 11 That the United States Congress is urged to pass, and 2 12 the President is urged to sign, legislation to 2 13 authorize the United States Food and Drug 2 14 Administration to regulate tobacco products under the 2 15 United States Food, Drug, and Cosmetics Act, 21 U.S.C. 2 16 } 301 et seq.; and 2 17 BE IT FURTHER RESOLVED, That copies of this 2 18 Resolution be transmitted to the President of the 2 19 United States and to each member of the Iowa 2 20 congressional delegation. 2 21 LSB 6243HH 81 2 22 pf:nh/sh/8 1
