  1 An Act relating to the electronic and written filing of personal
  2    financial disclosure statements, lobbyist registration
  3    statements, lobbyist reports, and lobbyist's client reports
  4    with the Iowa ethics and campaign disclosure board and the
  5    general assembly.

  1  1    Section 1.  Section 68B.35A, Code 2005, is amended by
  1  2 striking the section and inserting in lieu thereof the
  1  3 following:
  1  4    68B.35A  ELECTRONIC FILINGS == FEES == INTERNET ACCESS.
  1  5    1.  The board and each house of the general assembly shall
  1  6 accept electronic filings of disclosure statements,
  1  7 registration statements, and reports required under sections
  1  8 68B.35, 68B.36, 68B.37, and 68B.38.  If a person subject to
  1  9 such filing requirements elects to file electronically, the
  1 10 person shall file the disclosure statement, registration
  1 11 statement, or report with the board and, if the person is
  1 12 required to file the disclosure statement, registration
  1 13 statement, or report with a house of the general assembly, the
  1 14 board shall immediately transmit a copy of the electronic
  1 15 filing to the appropriate house of the general assembly.  For
  1 16 a person required to file with a house of the general
  1 17 assembly, the date the filing is received by the board is
  1 18 considered the date the filing is received by a house of the
  1 19 general assembly.
  1 20    2.  If a written disclosure statement, registration
  1 21 statement, or report is filed with a house of the general
  1 22 assembly, a copy of the disclosure statement, registration
  1 23 statement, or report shall be transmitted to the board for
  1 24 purposes of inclusion on an internet website as required in
  1 25 subsection 4.
  1 26    3.  The board may charge a filing fee not to exceed twenty
  1 27 dollars for each electronic filing.  The board and each house
  1 28 of the general assembly shall charge a filing fee of twenty=
  1 29 five dollars or more for each written filing.
  1 30    4.  The board shall record all written and electronic
  1 31 filings received by the board and each house of the general
  1 32 assembly as required under sections 68B.35, 68B.36, 68B.37,
  1 33 and 68B.38, on an internet website.
  1 34    5.  The board and each house of the general assembly shall
  1 35 agree on uniform electronic filing forms for disclosure
  2  1 statements, registration statements, and reports required
  2  2 under sections 68B.35, 68B.36, 68B.37, and 68B.38.
  2  3                           EXPLANATION
  2  4    This bill relates to the electronic and written filing of
  2  5 personal financial disclosure statements, lobbyist
  2  6 registration statements, lobbyist reports, and lobbyist's
  2  7 client reports with the Iowa ethics and campaign disclosure
  2  8 board and the general assembly.
  2  9    The bill requires the board and each house of the general
  2 10 assembly to accept electronic filings of personal financial
  2 11 disclosure statements, lobbyist registration statements,
  2 12 lobbyist reports, and lobbyist's client reports.  The bill
  2 13 provides that, if a person subject to the filing requirements
  2 14 elects to file electronically, the person shall file the
  2 15 disclosure statement, registration statement, or report with
  2 16 the board and, if the person is required to file the
  2 17 disclosure statement, registration statement, or report with a
  2 18 house of the general assembly, the board shall immediately
  2 19 transmit a copy of the electronic filing to the appropriate
  2 20 house of the general assembly.  The bill provides that, for a
  2 21 person required to file with a house of the general assembly,
  2 22 the date the filing is received by the board is considered the
  2 23 date the filing is received by a house of the general
  2 24 assembly.
  2 25    The bill provides that, if a written disclosure statement,
  2 26 registration statement, or report is filed with a house of the
  2 27 general assembly, a copy of the disclosure statement,
  2 28 registration statement, or report shall be transmitted to the
  2 29 board for purposes of inclusion on an internet website.  The
  2 30 bill requires the board to record all written and electronic
  2 31 filings received by the board and the general assembly on an
  2 32 internet website.
  2 33    The bill allows the board to charge a filing fee not to
  2 34 exceed $20 for each electronic filing.  The bill requires the
  2 35 board and each house of the general assembly to charge a
  3  1 filing fee of $25 or more for each written filing.
  3  2    The bill requires the board and each house of the general
  3  3 assembly to agree on uniform electronic filing forms for
  3  4 disclosure statements, registration statements, and reports.
