  1  1    Section 1.  Section 89A.3, Code 2005, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  7.  The commissioner shall adopt rules
  1  4 permitting elevators which are permitted for residential use
  1  5 to be used in an eligible church or house of worship where the
  1  6 elevators are only used to transport a restricted number of
  1  7 persons with special needs.  The rules shall provide that an
  1  8 elevator installed pursuant to this subsection shall be
  1  9 inspected upon the installation of the elevator and shall not
  1 10 be subject to any further inspection.  For purposes of this
  1 11 subsection, an "eligible church or house of worship" means a
  1 12 church or house of worship located in a building constructed
  1 13 prior to July 1, 2005, and with a building capacity of five
  1 14 hundred or fewer persons.
  1 15                           EXPLANATION
  1 16    This bill requires the labor commissioner to adopt rules
  1 17 allowing residential elevators in eligible churches where the
  1 18 elevators are only used to transport a restricted number of
  1 19 persons with special needs.  The bill further provides that
  1 20 once an elevator has been installed as permitted by this bill,
  1 21 it shall be subject to inspection only once.  The bill defines
  1 22 eligible churches as churches in buildings constructed prior
  1 23 to July 1, 2005, with a building capacity of 500 or fewer
  1 24 persons.
