  1  1                    DEPARTMENT FOR THE BLIND
  1  2    Section 1.  ADMINISTRATION.  There is appropriated from the
  1  3 general fund of the state to the department for the blind for
  1  4 the fiscal year beginning July 1, 2005, and ending June 30,
  1  5 2006, the following amount, or so much thereof as is
  1  6 necessary, to be used for the purposes designated:
  1  7    For salaries, support, maintenance, miscellaneous purposes
  1  8 and for not more than the following full=time equivalent

  2 17 261.85 shall be zero.
  2 18                 DEPARTMENT OF CULTURAL AFFAIRS
  2 19    Sec. 4.  There is appropriated from the general fund of the
  2 20 state to the department of cultural affairs for the fiscal
  2 21 year beginning July 1, 2005, and ending June 30, 2006, the
  2 22 following amounts, or so much thereof as is necessary, to be
  2 23 used for the purposes designated:

  3 18    Sec. 5.  There is appropriated from the general fund of the
  3 19 state to the department of education for the fiscal year
  3 20 beginning July 1, 2005, and ending June 30, 2006, the
  3 21 following amounts, or so much thereof as may be necessary, to
  3 22 be used for the purposes designated:
  3 23    1.  GENERAL ADMINISTRATION
  3 24    For salaries, support, maintenance, miscellaneous purposes,
  3 25 and for not more than the following full=time equivalent
  3 26 positions:

  3 29    The director of the department of education shall ensure
  3 30 that all school districts are aware of the state education
  3 31 resources available on the state website for listing teacher
  3 32 job openings and shall make every reasonable effort to enable
  3 33 qualified practitioners to post their resumes on the state
  3 34 website.  The department shall administer the posting of job
  3 35 vacancies for school districts, accredited nonpublic schools,
  4  1 and area education agencies on the state website.  The
  4  2 department may coordinate this activity with the Iowa school
  4  3 board association or other interested education associations
  4  4 in the state.  The department shall strongly encourage school
  4  5 districts to seek direct claiming under the medical assistance
  4  6 program for funding of school district nursing services for
  4  7 students.
  4  8    2.  VOCATIONAL EDUCATION ADMINISTRATION
  4  9    For salaries, support, maintenance, miscellaneous purposes,
  4 10 and for not more than the following full=time equivalent
  4 11 positions:

  4 14    3.  VOCATIONAL REHABILITATION SERVICES DIVISION
  4 15    a.  For salaries, support, maintenance, miscellaneous

  4 20    The division of vocational rehabilitation services shall
  4 21 seek funding from other sources, such as local funds, for
  4 22 purposes of matching the state's federal vocational
  4 23 rehabilitation allocation, as well as for matching other
  4 24 federal vocational rehabilitation funding that may become
  4 25 available.
  4 26    Except where prohibited under federal law, the division of
  4 27 vocational rehabilitation services of the department of
  4 28 education shall accept client assessments, or assessments of
  4 29 potential clients, performed by other agencies in order to
  4 30 reduce duplication of effort.
  4 31    Notwithstanding the full=time equivalent position limit
  4 32 established in this lettered paragraph, for the fiscal year
  4 33 ending June 30, 2006, if federal funding is received to pay
  4 34 the costs of additional employees for the vocational
  4 35 rehabilitation services division who would have duties
  5  1 relating to vocational rehabilitation services paid for
  5  2 through federal funding, authorization to hire not more than
  5  3 4.00 additional full=time equivalent employees shall be
  5  4 provided, the full=time equivalent position limit shall be
  5  5 exceeded, and the additional employees shall be hired by the
  5  6 division.
  5  7    b.  For matching funds for programs to enable persons with
  5  8 severe physical or mental disabilities to function more
  5  9 independently, including salaries and support, and for not
  5 10 more than the following full=time equivalent position:

  5 13    The highest priority use for the moneys appropriated under
  5 14 this lettered paragraph shall be for programs that emphasize
  5 15 employment and assist persons with severe physical or mental
  5 16 disabilities to find and maintain employment to enable them to
  5 17 function more independently.
  5 18    4.  STATE LIBRARY
  5 19    a.  For salaries, support, maintenance, miscellaneous
  5 20 purposes, and for not more than the following full=time
  5 21 equivalent positions:
  5 22 .................................................. $  1,378,555

  5 24    b.  For the enrich Iowa program:
  5 25 .................................................. $  1,698,432
  5 26    (1)  Funds allocated for purposes of the enrich Iowa
  5 27 program as provided in this lettered paragraph shall be
  5 28 distributed by the division of libraries and information
  5 29 services to provide support for Iowa's libraries.  The
  5 30 commission of libraries shall develop rules governing the
  5 31 allocation of funds provided by the general assembly for the
  5 32 enrich Iowa program to provide direct state assistance to
  5 33 public libraries and to fund the open access and access plus
  5 34 programs.  Direct state assistance to eligible public
  5 35 libraries is provided as an incentive to improve library
  6  1 services and to reduce inequities among communities in the
  6  2 delivery of library services based on recognized and adopted
  6  3 performance measures.  Funds distributed as direct state
  6  4 assistance shall be distributed to eligible public libraries
  6  5 that are in compliance with performance measures adopted by
  6  6 rule by the commission of libraries.  The funds allocated as
  6  7 provided in this lettered paragraph shall not be used for the
  6  8 costs of administration by the division.  The amount of direct
  6  9 state assistance distributed to each eligible public library
  6 10 shall be based upon the following:
  6 11    (a)  The level of compliance by the eligible public library
  6 12 with the performance measures adopted by the commission as
  6 13 provided in this subparagraph.
  6 14    (b)  The number of people residing within an eligible
  6 15 library's geographic service area for whom the library
  6 16 provides services.
  6 17    (c)  The amount of other funding the eligible public
  6 18 library received in the previous fiscal year for providing
  6 19 services to rural residents and to contracting communities.
  6 20    (2)  Moneys received by a public library under this
  6 21 lettered paragraph shall supplement, not supplant, any other
  6 22 funding received by the library.
  6 23    (3)  For purposes of this section, "eligible public
  6 24 library" means a public library that meets all of the
  6 25 following requirements:
  6 26    (a)  Submits to the division all of the following:
  6 27    (i)  The report provided for under section 256.51,
  6 28 subsection 1, paragraph "h".
  6 29    (ii)  An application and accreditation report, in a format
  6 30 approved by the commission, that provides evidence of the
  6 31 library's compliance with at least one level of the standards
  6 32 established in accordance with section 256.51, subsection 1,
  6 33 paragraph "k".
  6 34    (iii)  Any other application or report the division deems
  6 35 necessary for the implementation of the enrich Iowa program.
  7  1    (b)  Participates in the library resource and information
  7  2 sharing programs established by the state library.
  7  3    (c)  Is a public library established by city ordinance or a
  7  4 library district as provided in chapter 336.
  7  5    (4)  Each eligible public library shall maintain a separate
  7  6 listing within its budget for payments received and
  7  7 expenditures made pursuant to this lettered paragraph, and
  7  8 shall annually submit this listing to the division.
  7  9    (5)  By January 15, 2007, the division shall submit a
  7 10 program evaluation report to the general assembly and the
  7 11 governor detailing the uses and the impacts of funds allocated
  7 12 under this lettered paragraph.
  7 13    (6)  A public library that receives funds in accordance
  7 14 with this lettered paragraph shall have an internet use policy
  7 15 in place, which may or may not include internet filtering.
  7 16 The library shall submit a report describing the library's
  7 17 internet use efforts to the division.
  7 18    (7)  A public library that receives funds in accordance
  7 19 with this lettered paragraph shall provide open access, the
  7 20 reciprocal borrowing program, as a service to its patrons, at
  7 21 a reimbursement rate determined by the state library.
  7 22    5.  LIBRARY SERVICE AREA SYSTEM
  7 23    For state aid:

  7 25    6.  PUBLIC BROADCASTING DIVISION
  7 26    For salaries, support, maintenance, capital expenditures,
  7 27 miscellaneous purposes, and for not more than the following

  7 31    7.  REGIONAL TELECOMMUNICATIONS COUNCILS
  7 32    For state aid:
  7 33 .................................................. $  1,240,478
  7 34    The regional telecommunications councils established in
  7 35 section 8D.5 shall use the funds appropriated in this
  8  1 subsection to provide technical assistance for network
  8  2 classrooms, planning and troubleshooting for local area
  8  3 networks, scheduling of video sites, and other related support
  8  4 activities.
  8  5    8.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  8  6    For reimbursement for vocational education expenditures
  8  7 made by secondary schools:
  8  8 .................................................. $  2,936,904
  8  9    Funds appropriated in this subsection shall be used for
  8 10 expenditures made by school districts to meet the standards
  8 11 set in sections 256.11, 258.4, and 260C.14 as a result of the
  8 12 enactment of 1989 Iowa Acts, chapter 278.  Funds shall be used
  8 13 as reimbursement for vocational education expenditures made by
  8 14 secondary schools in the manner provided by the department of
  8 15 education for implementation of the standards set in 1989 Iowa
  8 16 Acts, chapter 278.
  8 17    9.  SCHOOL FOOD SERVICE
  8 18    For use as state matching funds for federal programs that
  8 19 shall be disbursed according to federal regulations, including
  8 20 salaries, support, maintenance, and miscellaneous purposes:

  8 22    10.  IOWA EMPOWERMENT FUND
  8 23    For deposit in the school ready children grants account of
  8 24 the Iowa empowerment fund created in section 28.9:
  8 25 .................................................. $ 22,481,594
  8 26    a.  From the moneys deposited in the school ready children
  8 27 grants account for the fiscal year beginning July 1, 2005, and
  8 28 ending June 30, 2006, not more than $300,000 is allocated for
  8 29 the community empowerment office and other technical
  8 30 assistance activities.  It is the intent of the general
  8 31 assembly that regional technical assistance teams will be
  8 32 established and will include staff from various agencies, as
  8 33 appropriate, including the area education agencies, community
  8 34 colleges, and the Iowa state university of science and
  8 35 technology cooperative extension service in agriculture and
  9  1 home economics.  The Iowa empowerment board shall direct staff
  9  2 to work with the advisory council to inventory technical
  9  3 assistance needs.  Funds allocated under this lettered
  9  4 paragraph may be used by the Iowa empowerment board for the
  9  5 purpose of skills development and support for ongoing training
  9  6 of the regional technical assistance teams.  However, funds
  9  7 shall not be used for additional staff or for the
  9  8 reimbursement of staff.
  9  9    b.  Notwithstanding any other provision of law to the
  9 10 contrary, the community empowerment office shall use the
  9 11 documentation created by the legislative services agency to
  9 12 continue the implementation of the four=year phase=in period
  9 13 of the distribution formula approved by the community
  9 14 empowerment board.
  9 15    c.  As a condition of receiving funding appropriated in
  9 16 this subsection, each community empowerment area board shall
  9 17 report to the Iowa empowerment board progress on each of the
  9 18 state indicators approved by the state board, as well as
  9 19 progress on local indicators.  The community empowerment area
  9 20 board must also submit a written plan amendment extending by
  9 21 one year the area's comprehensive school ready children grant
  9 22 plan developed for providing services for children from birth
  9 23 through five years of age and provide other information
  9 24 specified by the Iowa empowerment board.  The amendment may
  9 25 also provide for changes in the programs and services provided
  9 26 under the plan.  The Iowa empowerment board shall establish a
  9 27 submission deadline for the plan amendment that allows a
  9 28 reasonable period of time for preparation of the plan
  9 29 amendment and for review and approval or request for
  9 30 modification of the plan amendment by the Iowa empowerment
  9 31 board.  In addition, the community empowerment board must
  9 32 continue to comply with reporting provisions and other
  9 33 requirements adopted by the Iowa empowerment board in
  9 34 implementing section 28.8.
  9 35    d.  Of the amount appropriated in this subsection for
 10  1 deposit in the school ready children grants account of the
 10  2 Iowa empowerment fund, $1,000,000 shall be allocated to a
 10  3 collaborative effort between the Iowa community empowerment
 10  4 board and Iowa state university extension to provide hands=on
 10  5 assistance to child care providers.
 10  6    e.  Of the amount appropriated in this subsection for
 10  7 deposit in the school ready children grants account of the
 10  8 Iowa empowerment fund that is used for distribution to areas,
 10  9 $3,000,000 shall be used to assist low=income parents with
 10 10 preschool tuition.
 10 11    f.  Of the amount appropriated in this subsection for
 10 12 deposit in the school ready children grants account of the
 10 13 Iowa empowerment fund that is used for distribution to areas,
 10 14 $1,000,000 shall be used to collaborate with area education
 10 15 agencies and community colleges to provide both child care and
 10 16 preschool providers with ready access to high=quality
 10 17 professional development.
 10 18    11.  TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS
 10 19    To provide funds for costs of providing textbooks to each
 10 20 resident pupil who attends a nonpublic school as authorized by
 10 21 section 301.1.  The funding is limited to $20 per pupil and
 10 22 shall not exceed the comparable services offered to resident
 10 23 public school pupils:

 11 16    Sec. 6.  STATEWIDE TEACHER INTERN PROGRAM == FEDERAL GRANT
 11 17 APPLICATION COORDINATION.
 11 18    The department shall work cooperatively with the state
 11 19 board of regents and other appropriate eligible grantees to
 11 20 obtain any available federal funding, including grants that
 11 21 may be available for the establishment and operation of a
 11 22 teacher intern program.
 11 23    Sec. 7.  BOARD OF EDUCATIONAL EXAMINERS LICENSING FEES.
 11 24 Notwithstanding section 272.10, up to 85 percent of any funds
 11 25 received annually resulting from an increase in fees approved
 11 26 and implemented for licensing by the state board of
 11 27 educational examiners after July 1, 1997, and before June 30,
 11 28 2003, and up to 70 percent of any funds received annually
 11 29 resulting from an increase in fees approved and implemented
 11 30 for licensing by the state board after July 1, 2003, shall be
 11 31 available for the fiscal year beginning July 1, 2005, to the
 11 32 state board for purposes related to the state board's duties,
 11 33 including, but not limited to, additional full=time equivalent
 11 34 positions.  The director of the department of administrative
 11 35 services shall draw warrants upon the treasurer of state from
 12  1 the funds appropriated as provided in this section and shall
 12  2 make the funds resulting from the increase in fees available
 12  3 during the fiscal year to the state board on a monthly basis.
 12  4    Sec. 8.  MINIMUM TEACHER SALARY REQUIREMENTS == FY 2005=
 12  5 2006.
 12  6    1.  Notwithstanding section 284.7, subsection 1, paragraph
 12  7 "a", subparagraph (2), the minimum teacher salary paid by a
 12  8 school district or area education agency for purposes of
 12  9 teacher compensation in accordance with chapter 284, for the
 12 10 fiscal year beginning July 1, 2005, and ending June 30, 2006,
 12 11 shall be the minimum salary amount the school district or area
 12 12 education agency paid to a first=year beginning teacher or,
 12 13 the minimum salary amount the school district or area
 12 14 education agency would have paid a first=year beginning
 12 15 teacher if the school district or area education agency had
 12 16 participated in the program in the 2001=2002 school year, in
 12 17 accordance with section 284.7, subsection 1, Code Supplement
 12 18 2001.  If the school district or area education agency did not
 12 19 employ a first=year beginning teacher in the 2001=2002 school
 12 20 year, the minimum salary is the amount that the district would
 12 21 have paid a first=year beginning teacher under chapter 284 in
 12 22 the 2001=2002 school year.
 12 23    2.  Notwithstanding section 284.7, subsection 1, paragraph
 12 24 "b", subparagraph (2), the minimum career teacher salary paid
 12 25 to a career teacher who was a beginning teacher in the 2004=
 12 26 2005 school year, by a school district or area education
 12 27 agency participating in the student achievement and teacher
 12 28 quality program, for the school year beginning July 1, 2005,
 12 29 and ending June 30, 2006, shall be, unless the school district
 12 30 has a minimum career teacher salary that exceeds thirty
 12 31 thousand dollars, one thousand dollars greater than the
 12 32 minimum salary amount the school district or area education
 12 33 agency paid to a first=year beginning teacher if the school
 12 34 district or area education agency participated in the program
 12 35 during the 2001=2002 school year, or the minimum salary amount
 13  1 the school district or area education agency would have paid a
 13  2 first=year beginning teacher if the school district or area
 13  3 education agency had participated in the program in the 2001=
 13  4 2002 school year, in accordance with section 284.7, subsection
 13  5 1, Code Supplement 2001.
 13  6    3.  Notwithstanding section 284.7, subsection 1, paragraph
 13  7 "b", subparagraph (2), and except as provided in subsection 2,
 13  8 the minimum career teacher salary paid by a school district or
 13  9 area education agency participating in the student achievement
 13 10 and teacher quality program, for purposes of teacher
 13 11 compensation in accordance with chapter 284, for the school
 13 12 year beginning July 1, 2005, and ending June 30, 2006, shall
 13 13 be the minimum salary amount the school district or area
 13 14 education agency paid to a career teacher if the school
 13 15 district or area education agency participated in the program
 13 16 during the 2001=2002 school year, or, the minimum salary
 13 17 amount the school district or area education agency would have
 13 18 paid a career teacher if the school district or area education
 13 19 agency had participated in the program in the 2001=2002 school
 13 20 year, in accordance with section 284.7, subsection 1, Code
 13 21 Supplement 2001.
 13 22                     STATE BOARD OF REGENTS
 13 23    Sec. 9.  There is appropriated from the general fund of the
 13 24 state to the state board of regents for the fiscal year
 13 25 beginning July 1, 2005, and ending June 30, 2006, the
 13 26 following amounts, or so much thereof as may be necessary, to
 13 27 be used for the purposes designated:

 13 35 and the legislative services agency shall cooperate to
 14  1 determine and agree upon, by November 15, 2005, the amount
 14  2 that needs to be appropriated for tuition replacement for the
 14  3 fiscal year beginning July 1, 2006.
 14  4    The state board of regents shall submit a monthly financial
 14  5 report in a format agreed upon by the state board of regents
 14  6 office and the legislative services agency.
 14  7    b.  For allocation by the state board of regents to the
 14  8 state university of Iowa, the Iowa state university of science
 14  9 and technology, and the university of northern Iowa to
 14 10 reimburse the institutions for deficiencies in their operating
 14 11 funds resulting from the pledging of tuitions, student fees
 14 12 and charges, and institutional income to finance the cost of
 14 13 providing academic and administrative buildings and facilities
 14 14 and utility services at the institutions:

 21 17 appropriated from the general fund of the state to the
 21 18 institute for tomorrow's workforce created under chapter 7K,
 21 19 if enacted by this Act, for the fiscal year beginning July 1,
 21 20 2005, and ending June 30, 2006, the following amount, or so
 21 21 much thereof as is necessary, to be used for the purposes
 21 22 designated:
 21 23    For the activities of the institute created pursuant to
 21 24 section 7K.1, if enacted:

 21 26    Sec. 11.  MEDICAL ASSISTANCE == SUPPLEMENTAL AMOUNTS.  For
 21 27 the fiscal year beginning July 1, 2005, and ending June 30,
 21 28 2006, the department of human services shall continue the
 21 29 supplemental disproportionate share and a supplemental
 21 30 indirect medical education adjustment applicable to state=
 21 31 owned acute care hospitals with more than 500 beds and shall
 21 32 reimburse qualifying hospitals pursuant to that adjustment
 21 33 with a supplemental amount for services provided medical
 21 34 assistance recipients.  The adjustment shall generate
 21 35 supplemental payments intended to equal the state
 22  1 appropriation made to a qualifying hospital for treatment of
 22  2 indigent patients as provided in chapter 255.  To the extent
 22  3 of the supplemental payments, a qualifying hospital shall,
 22  4 after receipt of the funds, transfer to the department of
 22  5 human services an amount equal to the actual supplemental
 22  6 payments that were made in that month.  The aggregate amounts
 22  7 for the fiscal year shall not exceed the state appropriation
 22  8 made to the qualifying hospital for treatment of indigent
 22  9 patients as provided in chapter 255.  The department of human
 22 10 services shall deposit these funds in the department's medical
 22 11 assistance account.  To the extent that state funds
 22 12 appropriated to a qualifying hospital for the treatment of
 22 13 indigent patients as provided in chapter 255 have been
 22 14 transferred to the department of human services as a result of
 22 15 these supplemental payments made to the qualifying hospital,
 22 16 the department shall not, directly or indirectly, recoup the
 22 17 supplemental payments made to a qualifying hospital for any
 22 18 reason, unless an equivalent amount of the funds transferred
 22 19 to the department of human services by a qualifying hospital
 22 20 pursuant to this provision is transferred to the qualifying
 22 21 hospital by the department.
 22 22    If the state supplemental amount allotted to the state of
 22 23 Iowa for the federal fiscal year beginning October 1, 2005,
 22 24 and ending September 30, 2006, pursuant to section 1923(f)(3)
 22 25 of the federal Social Security Act, as amended, or pursuant to
 22 26 federal payments for indirect medical education is greater
 22 27 than the amount necessary to fund the federal share of the
 22 28 supplemental payments specified in the preceding paragraph,
 22 29 the department of human services shall increase the
 22 30 supplemental disproportionate share or supplemental indirect
 22 31 medical education adjustment by the lesser of the amount
 22 32 necessary to utilize fully the state supplemental amount or
 22 33 the amount of state funds appropriated to the state university
 22 34 of Iowa general education fund and allocated to the university
 22 35 for the college of medicine.  The state university of Iowa
 23  1 shall transfer from the allocation for the college of medicine
 23  2 to the department of human services, on a monthly basis, an
 23  3 amount equal to the additional supplemental payments made
 23  4 during the previous month pursuant to this paragraph.  A
 23  5 qualifying hospital receiving supplemental payments pursuant
 23  6 to this paragraph that are greater than the state
 23  7 appropriation made to the qualifying hospital for treatment of
 23  8 indigent patients as provided in chapter 255 shall be
 23  9 obligated as a condition of its participation in the medical
 23 10 assistance program to transfer to the state university of Iowa
 23 11 general education fund on a monthly basis an amount equal to
 23 12 the funds transferred by the state university of Iowa to the
 23 13 department of human services.  To the extent that state funds
 23 14 appropriated to the state university of Iowa and allocated to
 23 15 the college of medicine have been transferred to the
 23 16 department of human services as a result of these supplemental
 23 17 payments made to the qualifying hospital, the department shall
 23 18 not, directly or indirectly, recoup these supplemental
 23 19 payments made to a qualifying hospital for any reason, unless
 23 20 an equivalent amount of the funds transferred to the
 23 21 department of human services by the state university of Iowa
 23 22 pursuant to this paragraph is transferred to the qualifying
 23 23 hospital by the department.
 23 24    Continuation of the supplemental disproportionate share and
 23 25 supplemental indirect medical education adjustment shall
 23 26 preserve the funds available to the university hospital for
 23 27 medical and surgical treatment of indigent patients as
 23 28 provided in chapter 255 and to the state university of Iowa
 23 29 for educational purposes at the same level as provided by the
 23 30 state funds initially appropriated for that purpose.
 23 31    The department of human services shall, in any compilation
 23 32 of data or other report distributed to the public concerning
 23 33 payments to providers under the medical assistance program,
 23 34 set forth reimbursements to a qualifying hospital through the
 23 35 supplemental disproportionate share and supplemental indirect
 24  1 medical education adjustment as a separate item and shall not
 24  2 include such payments in the amounts otherwise reported as the
 24  3 reimbursement to a qualifying hospital for services to medical
 24  4 assistance recipients.
 24  5    For purposes of this section, "supplemental payment" means
 24  6 a supplemental payment amount paid for medical assistance to a
 24  7 hospital qualifying for that payment under this section.
 24  8    Sec. 12.  For the fiscal year beginning July 1, 2005, and
 24  9 ending June 30, 2006, the state board of regents may use
 24 10 notes, bonds, or other evidences of indebtedness issued under
 24 11 section 262.48 to finance projects that will result in energy
 24 12 cost savings in an amount that will cause the state board to
 24 13 recover the cost of the projects within an average of six
 24 14 years.
 24 15    Sec. 13.  Notwithstanding section 270.7, the department of
 24 16 administrative services shall pay the state school for the
 24 17 deaf and the Iowa braille and sight saving school the moneys
 24 18 collected from the counties during the fiscal year beginning
 24 19 July 1, 2005, for expenses relating to prescription drug costs
 24 20 for students attending the state school for the deaf and the
 24 21 Iowa braille and sight saving school.
 24 22    Sec. 14.  NEW SECTION.  7K.1  INSTITUTE FOR TOMORROW'S
 24 23 WORKFORCE.
 24 24    1.  FINDINGS.  The general assembly finds that Iowa's
 24 25 children are this state's greatest asset and to improve the
 24 26 future for Iowa's children, it is necessary to focus
 24 27 elementary, secondary, and postsecondary education efforts on
 24 28 what children need to know to be successful students and
 24 29 successful participants in Iowa's global workforce.  Iowa's
 24 30 community and business leaders are at the forefront of this
 24 31 ongoing conversation.  The general assembly further finds that
 24 32 the creation of an institute for tomorrow's workforce provides
 24 33 a long=term forum for bold, innovative recommendations to
 24 34 improve Iowa's education system to meet the workforce needs of
 24 35 Iowa's new economy.
 25  1    2.  INSTITUTE ESTABLISHED == DUTIES.  An institute for
 25  2 tomorrow's workforce is created as an independent agency,
 25  3 which shall, at a minimum, do the following:
 25  4    a.  Review educational standards to determine relevance and
 25  5 rigor necessary for continuous improvement in student
 25  6 achievement and meeting workforce needs.
 25  7    b.  Identify jobs skills and corresponding high school
 25  8 coursework necessary to achieve success in the Iowa workforce.
 25  9    c.  Review the state's education accountability measures,
 25 10 including but not limited to student proficiency and
 25 11 individual and organization program accountability.
 25 12    d.  Identify state and local barriers to improved student
 25 13 achievement and student success as well as barriers to sharing
 25 14 among and within all areas of Iowa's education system.
 25 15    e.  Identify effective education structure and delivery
 25 16 models that promote optimum student achievement opportunities
 25 17 for all Iowa students that include, but are not limited to,
 25 18 the role of technology.
 25 19    f.  Serve as a clearinghouse for existing and emerging
 25 20 innovative educational sharing and collaborative efforts among
 25 21 and between Iowa's secondary education system as well as
 25 22 Iowa's postsecondary education system.
 25 23    g.  Promote partnerships between private sector business
 25 24 and all areas of Iowa's education system.
 25 25    3.  MEMBERSHIP.  The board of directors of the institute
 25 26 for tomorrow's workforce shall consist of fifteen members
 25 27 serving staggered three=year terms who shall be appointed as
 25 28 follows:
 25 29    a.  Five members shall be appointed by the governor as
 25 30 follows:
 25 31    (1)  A school district superintendent from a school
 25 32 district with an enrollment of one thousand one hundred
 25 33 ninety=nine or fewer pupils.
 25 34    (2)  An individual representing an Iowa business employing
 25 35 more than two hundred fifty employees.
 26  1    (3)  A community college president.
 26  2    (4)  An individual representing labor and workforce
 26  3 interests.
 26  4    (5)  An individual representing a business that located in
 26  5 Iowa since the fiscal year beginning July 1, 1999.
 26  6    b.  Five members shall be appointed by the speaker of the
 26  7 house of representatives as follows:
 26  8    (1)  A school district superintendent from a school
 26  9 district with enrollment of more than one thousand one hundred
 26 10 ninety=nine pupils, but fewer than four thousand seven hundred
 26 11 forty=nine pupils.
 26 12    (2)  The president of an accredited private institution as
 26 13 defined in section 261.9.
 26 14    (3)  An individual representing an Iowa business employing
 26 15 fewer than fifty employees.
 26 16    (4)  An individual representing urban economic development
 26 17 interests.
 26 18    (5)  An individual from an association representing Iowa
 26 19 businesses.
 26 20    c.  Five members shall be appointed by the president of the
 26 21 senate as follows:
 26 22    (1)  A school district superintendent from a school
 26 23 district with enrollment of more than four thousand seven
 26 24 hundred forty=nine pupils.
 26 25    (2)  A president of an institution of higher education
 26 26 under the control of the state board of regents.
 26 27    (3)  An individual representing an Iowa business employing
 26 28 more than fifty employees but less than two hundred fifty
 26 29 employees.
 26 30    (4)  An individual representing rural economic development
 26 31 interests.
 26 32    (5)  An individual representing an Iowa agriculture
 26 33 association.
 26 34    Members, except as provided in paragraph "c", subparagraph
 26 35 (2), shall not be employed by the state.  One co=chairperson
 27  1 shall be appointed by the speaker of the house of
 27  2 representatives and one co=chairperson shall be appointed by
 27  3 the president of the senate.
 27  4    4.  MATCHING FUNDS REQUIREMENT.  Moneys appropriated by the
 27  5 general assembly for purposes of the institute for tomorrow's
 27  6 workforce shall be allocated only to the extent that the state
 27  7 funds are matched by the institute on a dollar=for=dollar
 27  8 basis.
 27  9    5.  REPORTING REQUIREMENTS.  The institute for tomorrow's
 27 10 workforce shall submit its findings and recommendations by
 27 11 January 15 annually in a report to the governor, the speaker
 27 12 of the house of representatives, the president of the senate,
 27 13 the state board of education, the state board of regents, the
 27 14 department of workforce development, the department of
 27 15 economic development, the Iowa association of community
 27 16 college trustees, the college student aid commission, the Iowa
 27 17 association of independent colleges and universities, and
 27 18 associations representing school boards, nonpublic schools,
 27 19 area education agencies, and teachers.
 27 20    6.  This chapter is repealed effective July 1, 2015.
 27 21    Sec. 15.  Section 257B.1B, subsection 1, Code 2005, is
 27 22 amended to read as follows:
 27 23    1.  Fifty=five percent of the moneys deposited in the fund
 27 24 to the department of education for allocation to the reading
 27 25 recovery center council to assist school districts in
 27 26 developing reading recovery programs.  The council shall
 27 27 submit a report on the use of the moneys it receives pursuant
 27 28 to this subsection annually to the department of education,
 27 29 the legislative services agency, and the chairpersons and
 27 30 ranking members of the house and senate standing committees on
 27 31 education and the joint appropriations subcommittee on
 27 32 education not later than January 15.
 27 33    Sec. 16.  Section 261.25, subsection 1, Code 2005, is
 27 34 amended to read as follows:
 27 35    1.  There is appropriated from the general fund of the
 28  1 state to the commission for each fiscal year the sum of forty=
 28  2 seven forty=nine million one six hundred fifty=seven seventy=
 28  3 three thousand five hundred fifteen seventy=five dollars for
 28  4 tuition grants.  From the funds appropriated in this
 28  5 subsection, not more than three four million four six hundred
 28  6 forty=six thousand dollars may be distributed to private
 28  7 institutions whose income is not exempt from taxation under
 28  8 section 501(c) of the Internal Revenue Code and whose students
 28  9 were eligible to receive Iowa tuition grant moneys in the
 28 10 fiscal year beginning July 1, 2003.  If the amount
 28 11 appropriated to the college student aid commission for tuition
 28 12 grants for the fiscal year beginning July 1, 2005, or
 28 13 succeeding fiscal years, exceeds the amount appropriated for
 28 14 the fiscal year beginning July 1, 2004, notwithstanding any
 28 15 other provision of this subsection, an amount equal to not
 28 16 more than ten percent of the total appropriation shall be
 28 17 reserved for distribution for students attending private
 28 18 institutions whose income is not exempt from taxation under
 28 19 section 501(c) of the Internal Revenue Code and whose students
 28 20 were eligible to receive Iowa tuition grant moneys in the
 28 21 fiscal year beginning July 1, 2003.  A for=profit institution
 28 22 which, effective March 9, 2005, purchased an accredited
 28 23 private institution that was exempt from taxation under
 28 24 section 501(c) of the Internal Revenue Code, shall be an
 28 25 eligible institution under the Iowa tuition grant program.
 28 26    Sec. 17.  Section 284.13, subsection 1, paragraphs a
 28 27 through c, Code 2005, are amended to read as follows:
 28 28    a.  For each fiscal year in the fiscal period beginning
 28 29 July 1, 2003, and ending June 30, 2005 2006, the department
 28 30 shall reserve up to five hundred thousand dollars of any
 28 31 moneys appropriated for purposes of this chapter.  For each
 28 32 fiscal year in which moneys are appropriated by the general
 28 33 assembly for purposes of team=based variable pay pursuant to
 28 34 section 284.11, the amount of moneys allocated to school
 28 35 districts shall be in the proportion that the basic enrollment
 29  1 of a school district bears to the sum of the basic enrollments
 29  2 of all participating school districts for the budget year.
 29  3 However, the per pupil amount distributed to a school district
 29  4 under the pilot program shall not exceed one hundred dollars.
 29  5    b.  For the fiscal year beginning July 1, 2004 2005, and
 29  6 ending June 30, 2005 2006, to the department of education, the
 29  7 amount of one two million one hundred thousand dollars for the
 29  8 issuance of national board certification awards in accordance
 29  9 with section 256.44.
 29 10    c.  For the fiscal year beginning July 1, 2004 2005, and
 29 11 succeeding fiscal years, an amount up to three four million
 29 12 five one hundred thousand dollars for first=year and second=
 29 13 year beginning teachers, to the department of education for
 29 14 distribution to school districts for purposes of the beginning
 29 15 teacher mentoring and induction programs.  A school district
 29 16 shall receive one thousand three hundred dollars per beginning
 29 17 teacher participating in the program.  If the funds
 29 18 appropriated for the program are insufficient to pay mentors
 29 19 and school districts as provided in this paragraph, the
 29 20 department shall prorate the amount distributed to school
 29 21 districts based upon the amount appropriated.  Moneys received
 29 22 by a school district pursuant to this paragraph shall be
 29 23 expended to provide each mentor with an award of five hundred
 29 24 dollars per semester, at a minimum, for participation in the
 29 25 school district's beginning teacher mentoring and induction
 29 26 program; to implement the plan; and to pay any applicable
 29 27 costs of the employer's share of contributions to federal
 29 28 social security and the Iowa public employees' retirement
 29 29 system or a pension and annuity retirement system established
 29 30 under chapter 294, for such amounts paid by the district.
 29 31    Sec. 18.  Section 284.13, subsection 1, paragraph e, Code
 29 32 2005, is amended to read as follows:
 29 33    e.  For the fiscal year beginning July 1, 2004 2005, and
 29 34 ending June 30, 2005 2006, up to two one hundred fifty eighty=
 29 35 five thousand dollars to the department of education for
 30  1 purposes of implementing the career development program
 30  2 requirements of section 284.6, and the review panel
 30  3 requirements of section 284.9.  From the moneys allocated to
 30  4 the department pursuant to this paragraph, not less than
 30  5 seventy=five ten thousand dollars shall be used to administer
 30  6 the ambassador to education position in accordance with
 30  7 section 256.45 distributed to the board of educational
 30  8 examiners for purposes of convening an educator licensing
 30  9 review working group.  A portion of the funds allocated to the
 30 10 department for purposes of this paragraph may be used by the
 30 11 department for administrative purposes.  Notwithstanding
 30 12 section 8.33, moneys allocated for purposes of this paragraph
 30 13 prior to July 1, 2004, which remain unobligated or unexpended
 30 14 at the end of the fiscal year for which the moneys were
 30 15 appropriated, shall remain available for expenditure for the
 30 16 purposes for which they were allocated, for the fiscal year
 30 17 beginning July 1, 2004, and ending June 30, 2005.
 30 18    Sec. 19.  Section 284.13, subsection 1, Code 2005, is
 30 19 amended by adding the following new paragraph:
 30 20    NEW PARAGRAPH.  dd.  For the fiscal year beginning July 1,
 30 21 2005, and ending June 30, 2006, up to eight million nine
 30 22 hundred thousand dollars to the department of education for
 30 23 use by school districts to add one additional teacher contract
 30 24 day to the school calendar.  Prior to receiving funds under
 30 25 this paragraph, a school district shall submit for approval to
 30 26 the department the school district's professional development
 30 27 plan for use of the moneys.  From the moneys allocated to the
 30 28 department pursuant to this paragraph, not less than seventy=
 30 29 five thousand dollars shall be used to administer the
 30 30 ambassador to education position in accordance with section
 30 31 256.45 and the reporting and plan requirements of this
 30 32 subsection shall not apply to this allocation.  The department
 30 33 shall submit a report on school district use of the moneys
 30 34 distributed pursuant to this paragraph to the chairpersons and
 30 35 ranking members of the house and senate standing committees on
 31  1 education, the joint appropriations subcommittee on education,
 31  2 and the legislative services agency not later than January 15,
 31  3 2006.
 31  4                           EXPLANATION
 31  5    This bill appropriates moneys for fiscal year 2005=2006
 31  6 from the general fund of the state to the college student aid
 31  7 commission, the department for the blind, the department of
 31  8 cultural affairs, the department of education, and the state
 31  9 board of regents and its institutions.  The bill also creates
 31 10 and appropriates moneys for FY 2005=2006 from the general fund
 31 11 to an institute for tomorrow's workforce.
 31 12    The bill appropriates to the department for the blind for
 31 13 its administration.
 31 14    The bill includes appropriations to the college student aid
 31 15 commission for general administrative purposes, student aid
 31 16 programs, an initiative directing primary care physicians to
 31 17 areas of the state experiencing physician shortages,
 31 18 forgivable loans for Des Moines university == osteopathic
 31 19 medical center students, the national guard educational
 31 20 assistance program, and the teacher shortage forgivable loan
 31 21 program.  The bill nullifies the $2.75 million standing
 31 22 appropriation for the Iowa work=study program for fiscal year
 31 23 2005=2006.  The bill increases the standing appropriation for
 31 24 Iowa tuition grants by approximately $2.52 million.  The bill
 31 25 amends a Code provision to replace a reference to the reading
 31 26 recovery center with a reference to the reading recovery
 31 27 council and requires the council to provide an annual report
 31 28 on use of the state funds to the department of education, the
 31 29 legislative services agency, and the general assembly.
 31 30    The bill appropriates to the department of cultural affairs
 31 31 for its arts, historical and administration divisions, for
 31 32 historic sites, and for community cultural grants.
 31 33    The bill appropriates moneys to the department of education
 31 34 for purposes of the department's general administration,
 31 35 vocational education administration, division of vocational
 32  1 rehabilitation services, independent living, state library for
 32  2 general administration and the enrich Iowa program, library
 32  3 service area system, public broadcasting division, regional
 32  4 telecommunications councils, vocational education to secondary
 32  5 schools, school food service, Iowa empowerment fund, textbooks
 32  6 for nonpublic school pupils, student achievement and teacher
 32  7 quality program including an allocation for school districts
 32  8 to fund an additional teacher contract day and community
 32  9 colleges.
 32 10    The bill appropriates moneys to the state board of regents
 32 11 for the board office, for tuition replacement, universities'
 32 12 general operating budgets, the southwest Iowa graduate studies
 32 13 center, the tristate graduate center, the quad=cities graduate
 32 14 studies center, Iowa's obligation as a member of the
 32 15 Midwestern higher education compact, the state university of
 32 16 Iowa, Iowa state university of science and technology, the
 32 17 university of northern Iowa, the Iowa school for the deaf, the
 32 18 Iowa braille and sight saving school, and for tuition and
 32 19 transportation costs for students residing in the Iowa braille
 32 20 and sight saving school, and the Iowa school for the deaf.
 32 21    The institute for tomorrow's workforce is created as an
 32 22 independent agency to provide a long=term focus on bold,
 32 23 innovative recommendations to improve Iowa's education system
 32 24 to meet the workforce needs of Iowa's new economy.  The
 32 25 membership of the agency is comprised of 15 members serving
 32 26 three=year staggered terms.  With the exception of the
 32 27 president of a regents university, none of the members shall
 32 28 be employed by the state.  State moneys shall be allocated
 32 29 only to the extent that the state funds are matched on a $1
 32 30 for $1 basis by the institute.  The chapter creating the
 32 31 institute is repealed effective July 1, 2015.
