                                      A BILL FOR

  1 An Act providing an exemption to the qualifications for school
  2    bus drivers for hearing=impaired individuals authorized to
  3    transport students or clients by the superintendent of the
  4    Iowa braille and sight saving school or the state school for
  5    the deaf.
  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.375, Code 2005, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  4.  Notwithstanding any provision to the
  1  4 contrary, an individual who is hearing=impaired and who
  1  5 otherwise meets the requirements of this section is exempt
  1  6 from the certificate of qualification requirement of
  1  7 subsection 1, paragraph "d", if the individual meets all of
  1  8 the following conditions:
  1  9    a.  The individual is authorized to transport students or
  1 10 clients by the superintendent of the Iowa braille and sight
  1 11 saving school or of the Iowa school for the deaf, or the
  1 12 superintendent's respective designee.
  1 13    b.  The individual is an employee of the Iowa braille and
  1 14 sight saving school or the Iowa school for the deaf.
  1 15    c.  The vehicle the individual operates for the
  1 16 transportation of children to or from school is designed to
  1 17 carry not more than fifteen persons as passengers.
  1 18                           EXPLANATION
  1 19    This bill exempts a hearing=impaired individual from a
  1 20 provision that requires a school bus driver to possess a
  1 21 current certificate of qualification for operation of a
  1 22 commercial motor vehicle, if the individual is authorized to
  1 23 transport students or clients by the superintendent of the
  1 24 Iowa braille and sight saving school or of the Iowa school for
  1 25 the deaf, or the superintendent's respective designee, the
  1 26 individual is an employee of the Iowa braille and sight saving
  1 27 school or the Iowa school for the deaf, and the individual
  1 28 operates a vehicle that is designed to carry not more than 15
  1 29 persons as passengers.
