  1  1    Section 1.  NEW SECTION.  598.7B  PARENTING PLANS.
  1  2    1.  Beginning October 1, 2005, the parties to a petition
  1  3 for dissolution of marriage, annulment, or separate
  1  4 maintenance that involves minor children or to an application
  1  5 for a motion to modify an order involving custody or
  1  6 visitation shall submit a proposed parenting plan, either
  1  7 individually or jointly, within thirty days after the service
  1  8 of process of the petition for dissolution of marriage,
  1  9 annulment, or separate maintenance, or the application for a
  1 10 motion to modify an order involving custody or visitation.
  1 11 The proposed parenting plan shall specify the arrangements
  1 12 that the party believes to be in the best interest of any
  1 13 minor child and shall specify other details as required by
  1 14 rules prescribed by the supreme court.
  1 15    2.  The supreme court shall prescribe rules no later than
  1 16 September 1, 2005, establishing guidelines for a parenting
  1 17 plan form which may be used by the parties in any dissolution
  1 18 of marriage, annulment, legal separation, or modification
  1 19 proceeding involving the issues of custody and visitation.
  1 20 Beginning September 1, 2005, the clerk of the district court
  1 21 shall furnish parenting plan forms to the parties in a
  1 22 dissolution of marriage, annulment, or separate maintenance
  1 23 action or modification proceeding involving custody or
  1 24 visitation, without cost to the parties.
  1 25    Sec. 2.  EFFECTIVE DATE.  The provision of the section of
  1 26 this Act enacting section 598.7B that directs the supreme
  1 27 court to prescribe rules regarding the guidelines for
  1 28 parenting plans, being deemed of immediate importance, takes
  1 29 effect upon enactment.
  1 30                           EXPLANATION
  1 31    This bill requires the parties to a petition for
  1 32 dissolution of marriage, annulment, or separate maintenance
  1 33 that involves minor children, or to an application for a
  1 34 motion to modify an order involving custody or visitation,
  1 35 beginning October 1, 2005, to submit a proposed parenting plan
  2  1 within 30 days after service of process of the petition or
  2  2 application.  The bill directs the supreme court to prescribe
  2  3 rules for guidelines for the parenting plan form and directs
  2  4 the clerks of the district court to furnish parenting plan
  2  5 forms to specified parties beginning September 1, 2005.  The
  2  6 supreme court directive takes effect upon enactment.
