Section 321.34, subsection 12A, Code 2005, is 1 2 amended to read as follows: 1 3 12A. SPECIAL REGISTRATION PLATES == ARMED FORCES SERVICES. 1 4 a. An owner of a type of vehicle referred to in subsection 1 5 12 who applies for any type of special registration plates 1 6 associated with service in the United States armed forces 1 7 shall be issued one set of the special registration plates at 1 8 no charge, but shall be subject to the annual registration fee 1 9 of fifteen dollars, if all of the following conditions are 1 10 met: 1 11a.(1) The owner is eligible for, but has relinquished to 1 12 the department or the county treasurer or has not been issued, 1 13 congressional medal of honor, ex=prisoner of war, or legion of 1 14 merit special registration plates under this section, or 1 15 disabled veteran registration plates under section 321.105. 1 16b.(2) The owner provides the appropriate information 1 17 regarding the owner's eligibility for any of the special 1 18 registration plates described in paragraph "a", and regarding 1 19 the owner's eligibility for the special registration plates 1 20 for which the owner has applied, as required by the 1 21 department. 1 22 b. A disabled veteran who is the owner of a type of 1 23 vehicle referred to in subsection 12 may apply for and receive 1 24 one set of any type of special registration plates associated 1 25 with service in the United States armed forces. The plates 1 26 shall be issued at no charge, but shall be subject to an 1 27 annual registration fee of five dollars. For purposes of this 1 28 paragraph, "disabled veteran" means a person who has suffered, 1 29 as a result of military service, at least a fifty percent 1 30 service=connected disability, or at least a forty percent 1 31 service=connected disability because of the amputation of a 1 32 lower extremity, and receives compensation from the United 1 33 States because of the disability. 1 34 c. A seriously disabled veteran who receives special 1 35 plates under this subsection shall be exempt from payment of 2 1 thefifteen dollarannual registration fee as provided in 2 2 section 321.105. 2 3 d. Upon the death of the vehicle owner entitled to the 2 4 special registration plates, the special registration plates 2 5 shall be surrendered to the department or the county 2 6 treasurer. 2 7 EXPLANATION 2 8 This bill provides that a disabled veteran is eligible to 2 9 receive one set of any of the special motor vehicle 2 10 registration plates associated with service in the armed 2 11 forces at no charge. The annual registration fee for a 2 12 disabled veteran's motor vehicle registered with the special 2 13 plates is $5, which is in lieu of the regular registration fee 2 14 and the special plate fee. The bill defines "disabled 2 15 veteran" as a person who has suffered, as a result of military 2 16 service, at least a 50 percent service=connected disability, 2 17 or at least a 40 percent service=connected disability because 2 18 of the amputation of a lower extremity, and receives 2 19 compensation from the United States because of the disability. 2 20 Certain seriously disabled veterans who have been provided 2 21 with a vehicle by the United States government are not 2 22 required to pay the annual registration fee for their 2 23 vehicles. 2 24 LSB 2591YH 81 2 25 dea:nh/sh/8
