1 An Act requiring health care providers, hospitals, and designated
2 employees to inform patients of inclusion on the patient's
3 insurance provider list under specified circumstances.

1 1 Section 1. NEW SECTION. 135.20 PATIENT INSURANCE
1 2 COVERAGE == REQUIRED DISCLOSURE.
1 3 1. For the purposes of this section, unless the context
1 4 otherwise requires:
1 5 a. "Health care provider" means a physician licensed
1 6 pursuant to chapter 148, 150, 150A, or 151.
1 7 b. "Hospital" means a hospital as defined in section
1 8 135B.1.
1 9 2. Prior to providing nonemergency medical care or
1 10 treatment, a health care provider, a hospital, or an employee
1 11 of a health care provider or hospital responsible for patient
1 12 intake or admission, shall inform the patient regarding
1 13 inclusion of the health care provider or hospital on the
1 14 patient's insurance provider list.
1 15 3. A violation of this section by a health care provider,
1 16 or an employee of a health care provider responsible for
1 17 patient intake or admission, shall subject the health care
1 18 provider to the penalty provisions of section 147.86 and the
1 19 licensee disciplinary provisions of chapter 272C.
1 20 4. A violation of this section by a hospital, or an
1 21 employee of a hospital responsible for patient intake or
1 22 admission, shall subject the hospital to penalties to be
1 23 determined by the department by rule, with the advice and
1 24 approval of the hospital licensing board, pursuant to section
1 25 135B.7.
1 26 EXPLANATION
1 27 This bill provides that a health care provider, a hospital,
1 28 or an employee of either responsible for patient intake and
1 29 admission must inform patients of inclusion of the provider or
1 30 hospital on the patient's insurance provider list prior to
1 31 providing nonemergency medical or health treatment.
1 32 The bill defines a "health care provider" as a physician
1 33 licensed pursuant to Code chapter 148, 150, 150A, or 151, and
1 34 a "hospital" as an entity as defined in Code section 135B.1,
1 35 subsection 3.
2 1 The bill provides that violations by a health care provider
2 2 or an employee shall subject the health care provider to
2 3 specified penalty provisions, and provides that similar
2 4 violations by a hospital or its employee shall subject the
2 5 hospital to penalties to be determined by the Iowa department
2 6 of public health by rule, with the advice and approval of the
2 7 hospital licensing board.
