  1  1    Section 1.  Section 80B.11B, subsection 2, Code 2005, is
  1  2 amended to read as follows:
  1  3    2.  The Iowa law enforcement academy may also charge the
  1  4 department of natural resources or other agency or department
  1  5 of the state, a member of a police force of a city or county,
  1  6 a member of the Iowa national guard awarded a scholarship
  1  7 under section 80B.19, or any political subdivision of the
  1  8 state not more than one=half of the cost of providing the
  1  9 basic training course which is designed to meet the minimum
  1 10 basic training requirements for a law enforcement officer.
  1 11 All other candidates to the law enforcement academy, including
  1 12 a candidate from a tribal government, shall pay the full costs
  1 13 of providing the basic training requirements for a law
  1 14 enforcement officer.
  1 15    Sec. 2.  NEW SECTION.  80B.19  IOWA NATIONAL GUARD LAW
  1 16 ENFORCEMENT TRAINING SCHOLARSHIP PROGRAM == APPROPRIATION.
  1 17    1.  An Iowa national guard law enforcement training
  1 18 scholarship program is established to be administered by the
  1 19 department of public defense for members of the Iowa national
  1 20 guard who qualify and are accepted for attendance at the Iowa
  1 21 law enforcement academy.  The purpose of the program is to
  1 22 provide scholarships to members of the Iowa national guard who
  1 23 qualify for training to meet the minimum basic training
  1 24 requirements for a law enforcement officer at the Iowa law
  1 25 enforcement academy.  The provisions of sections 80B.11D and
  1 26 80B.11E requiring sponsorship by a law enforcement agency
  1 27 shall not apply to an individual who meets the requirements of
  1 28 this section and who otherwise meets the requirements for
  1 29 acceptance at the Iowa law enforcement academy pursuant to
  1 30 this chapter.  An individual is eligible for the Iowa national
  1 31 guard law enforcement training scholarship program if the
  1 32 individual meets all of the following conditions:
  1 33    a.  Is a resident of the state and a member of an Iowa army
  1 34 or air national guard unit while receiving a scholarship
  1 35 pursuant to this section.
  2  1    b.  Satisfactorily completed required initial active duty
  2  2 training.
  2  3    c.  Maintains satisfactory performance of duty upon return
  2  4 from initial active duty training, including attending a
  2  5 minimum of ninety percent of scheduled drill dates and
  2  6 attending annual training.
  2  7    d.  Is accepted for training to meet the minimum basic
  2  8 training requirements for a law enforcement officer at the
  2  9 Iowa law enforcement academy.
  2 10    e.  Expresses an interest in pursuing a law enforcement
  2 11 career.
  2 12    f.  Receives the recommendation of the Iowa national guard
  2 13 member's company commander.
  2 14    g.  Meets any other requirement established by rule by the
  2 15 adjutant general pursuant to subsection 3.
  2 16    h.  Submits an application to the adjutant general of Iowa,
  2 17 on forms prescribed by the adjutant general, who shall
  2 18 determine eligibility for the scholarship and whose decision
  2 19 is final.
  2 20    2.  A scholarship paid pursuant to this section shall not
  2 21 exceed the difference between the cost of providing the basic
  2 22 training course which is designed to meet the minimum basic
  2 23 training requirements for a law enforcement officer and the
  2 24 amount the Iowa law enforcement agency charges a member of a
  2 25 police force of a city or county as provided in section
  2 26 80B.11B.  An Iowa national guard member who receives a
  2 27 scholarship pursuant to this section shall be responsible for
  2 28 paying the amount the Iowa law enforcement academy is
  2 29 permitted to charge a member of a police force of a city or
  2 30 county as provided in section 80B.11B.  Annually, not more
  2 31 than one hundred scholarships shall be awarded by the adjutant
  2 32 general pursuant to this section.  Scholarship eligibility
  2 33 determinations shall not be based upon a national guard
  2 34 member's unit, the location at which drills are attended, or
  2 35 whether the individual is a member of the Iowa army or air
  3  1 national guard.
  3  2    3.  The adjutant general shall adopt rules pursuant to
  3  3 chapter 17A establishing the following:
  3  4    a.  Procedures for disseminating material regarding the
  3  5 scholarship program to members of the Iowa national guard.
  3  6    b.  Procedures for receiving scholarship applications from
  3  7 members of the Iowa national guard.
  3  8    c.  Any additional requirements that the adjutant general
  3  9 determines the applicants shall meet in order to be awarded a
  3 10 scholarship.
  3 11    d.  Procedures and criteria for evaluating applicants and
  3 12 awarding scholarships under this section.
  3 13    4.  The eligibility of applicants and scholarship amounts
  3 14 to be paid shall be certified by the adjutant general of Iowa
  3 15 to the department of public defense, and all amounts that are
  3 16 or become due to the Iowa law enforcement academy except as
  3 17 provided in subsection 2 shall be paid to the Iowa law
  3 18 enforcement academy by the department of public defense upon
  3 19 receipt of certification by the director of the Iowa law
  3 20 enforcement academy as to accuracy of charges made, and as to
  3 21 the attendance and academic progress of the individual at the
  3 22 academy.  The department of public defense shall maintain an
  3 23 annual record of the number of participants and the dollar
  3 24 value of the scholarships awarded.
  3 25    5.  There is appropriated from the general fund of the
  3 26 state an amount necessary to pay the scholarship amounts
  3 27 awarded under the Iowa national guard law enforcement training
  3 28 scholarship program pursuant to this section.
  3 29                           EXPLANATION
  3 30    This bill establishes an Iowa national guard law
  3 31 enforcement training scholarship program to be administered by
  3 32 the department of public defense for members of the Iowa
  3 33 national guard who qualify and are accepted for attendance at
  3 34 the Iowa law enforcement academy.
  3 35    An individual is eligible for the program if the individual
  4  1 is a resident of the state and a member of an Iowa army or air
  4  2 national guard unit, satisfactorily completed required initial
  4  3 active duty training, maintains satisfactory performance of
  4  4 duty, expresses an interest in pursuing a law enforcement
  4  5 career, receives the recommendation of their company
  4  6 commander, meets any other requirement established by the
  4  7 adjutant general, and submits an application to the adjutant
  4  8 general.
  4  9    The amount of scholarship moneys paid shall not exceed the
  4 10 difference between the cost of providing the basic training
  4 11 course which is designed to meet the minimum basic training
  4 12 requirements for a law enforcement officer and the amount the
  4 13 Iowa law enforcement agency charges a member of a police force
  4 14 of a city or county under the current Code, which is not more
  4 15 than one=half of the cost of providing the basic training
  4 16 course.  An Iowa national guard member who receives a
  4 17 scholarship is responsible for paying the balance.  Annually,
  4 18 not more than 100 scholarships shall be awarded.  Scholarship
  4 19 eligibility determinations shall not be based upon a national
  4 20 guard member's unit, the location at which drills are
  4 21 attended, or whether the individual is a member of the Iowa
  4 22 army or air national guard.
  4 23    The adjutant general is directed to adopt rules
  4 24 establishing procedures and criteria for evaluating applicants
  4 25 and awarding the scholarships and procedures for disseminating
  4 26 material about the program to guard members and may establish
  4 27 by rule additional program requirements.
  4 28    The bill includes a standing, unlimited appropriation to
  4 29 the department of public defense to pay for scholarships
  4 30 awarded under the program.
