  1 An Act creating a special animal friendly motor vehicle
  2    registration plate, establishing fees, and making an
  3    appropriation.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.34, Code 2005, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  24.  ANIMAL FRIENDLY PLATES.
  1  4    a.  Upon application and payment of the proper fees, the
  1  5 director may issue animal friendly plates to an owner of a
  1  6 motor vehicle referred to in subsection 12.
  1  7    b.  Animal friendly plates shall be designed by the
  1  8 department in consultation with the Iowa board of veterinary
  1  9 medicine.
  1 10    c.  The special fee for letter number designated animal
  1 11 friendly plates is thirty=five dollars.  The fee for
  1 12 personalized animal friendly plates is twenty=five dollars,
  1 13 which shall be paid in addition to the special animal friendly
  1 14 fee of thirty=five dollars.  The fees collected by the
  1 15 director under this subsection shall be paid monthly to the
  1 16 treasurer of state and credited to the road use tax fund.
  1 17 Notwithstanding section 423.43, and prior to the crediting of
  1 18 revenues to the road use tax fund under section 423.43,
  1 19 subsection 1, paragraph "b", the treasurer of state shall
  1 20 transfer monthly from those revenues to the department of
  1 21 agriculture and land stewardship the amount of the special
  1 22 fees collected in the previous month for the animal friendly
  1 23 plates and such funds are appropriated to the department of
  1 24 agriculture and land stewardship.  The Iowa board of
  1 25 veterinary medicine shall distribute one hundred percent of
  1 26 the funds received monthly in the form of targeted grants to
  1 27 public or private organizations that are engaged in pet
  1 28 population control efforts, including but not limited to
  1 29 nonprofit spay and neuter clinics.  Notwithstanding section
  1 30 8.33, moneys transferred under this subsection shall not
  1 31 revert to the general fund of the state.
  1 32    d.  Upon receipt of the special registration plates, the
  1 33 applicant shall surrender the current registration plates to
  1 34 the county treasurer.  The county treasurer shall validate the
  1 35 special registration plates in the same manner as regular
  2  1 registration plates are validated under this section.  The
  2  2 annual special animal friendly fee for letter number
  2  3 designated plates is ten dollars, which shall be paid in
  2  4 addition to the regular annual registration fee.  The annual
  2  5 fee for personalized animal friendly plates is five dollars,
  2  6 which shall be paid in addition to the annual special animal
  2  7 friendly fee and the regular annual registration fee.  The
  2  8 annual special animal friendly fee shall be credited and
  2  9 transferred as provided under paragraph "c".
  2 10                           EXPLANATION
  2 11    This bill creates a special animal friendly motor vehicle
  2 12 registration plate bearing an emblem to be designed by the
  2 13 state department of transportation in consultation with the
  2 14 Iowa board of veterinary medicine.  The plate will be issued
  2 15 for a special fee of $35, plus an additional $25 for a
  2 16 personalized plate.  The annual special renewal fee, which is
  2 17 in addition to the regular annual registration fee for the
  2 18 vehicle, is $10, plus an additional $5 for personalized
  2 19 plates.  Moneys from the $35 special plate issuance fee and
  2 20 the $10 special plate renewal fee are appropriated to the
  2 21 department of agriculture and land stewardship.  The board of
  2 22 veterinary medicine shall distribute the funds in the form of
  2 23 grants to public and private organizations that work to
  2 24 control pet overpopulation, such as nonprofit spay and neuter
  2 25 clinics.
